Tier4 general student refusal on basis of 245ZX(d)

Post by rony0044 » Tue Mar 04, 2014 12:18 am

Dear Sir/Madam,
I am Nusrat Jahan, applied for my extension with my dependent on 8th of February 2014(online) and send my documents on 10th of February 2014(by post). I was refused by saying that I needed to show £2000 for my self and £1200 for my dependent all together £3200 in my account. But I did show £2397 in my bank account and my dependent showed £8000 in his bank account (both for 28 days statements from different bank accounts).
Moreover they gave decision on 27th of February 2014 and I received the letter on 3rd of March 2014. The main problem in here is that my visa expired on 28th of February 2014. Just one day before my visa expires;they made their decision.

As because they made the decision on 27th of February, just one day before my visa expires, they did not give me the right of Appeal. And I received their decision letter on 3rd of March(by post).

I could not find their valid reasons basis of 245ZX(d) in the policy guideline. If you have any idea about it please tell me about it and also please let me know where I can find it. I will also be grateful to you if you please advice me what to do next.

Thank you,
With regards,
Nusrat Jahan.

Thanks for your replay ,
Exactly that's what I also want to know that, why they refused us?! when I submitted both of our bank statements with sufficient amount. They gave me 30 points for my CAS, but gave 0 for maintenance only showed that reason. Moreover we send our documents in same envelop and same day together. But yesterday I received my passport and my documents with the refusal, but my husband did not get his passport and any documents yet.

Please tell what will the best step for me to take at this moment.

@ Nusrat Jahan
You can make a written request to them for review the case(if u r sure that they made a mistake). And when u make a request, write down all the situation and highlight the mistake aswell.
if they reply for this request then well n gud.if not then u need to go for judical review.

That's unreasonable. Appeal anyway and let a judge decide if you have a right of appeal.

i think so u made a little mistake when u applied.U are main applicant.
u should have written a covering letter with ur application explaning that i m using 2 bank statements for my maintainance. One is mine wd this much money n rest of money in my dependant's account.I think so Case Worker thought that u submitted just ur bank statement.

@Adilzia, I did not mention about this because in the checklist and in the application as well I did mention that I gave my bank statement and my spouse's bank statement ( i choose the option YES). So, does it mean that the immigration officers do not read and even see the application and the documents we submit!!!

I am really shocked about their decision.

Thanks everyone for your comments and advises. I will definitely protest against their decision, which is totally wrong and unfair.

Consult this matter wd ur solicitor.
I think so HO doesnt review refused cases.
But in some cases where they find that they made mistake blindly. They accept aplicant's request of review.
And dont worry.i hope u will get ur visa in review.if its not happen.
Then u will get definately in JR.

Hello everyone,
I am going through a serious problem, that is on 3rd of March I was refused for the ground of maintenance funds, as because it was their mistake so my application has been taken for the reconsideration on 10th of March.
But last night I saw that my date of birth in the application form and the bio-metric letter is incorrect. I did contact with the Home Office and they said that my date of birth in their system is correct. The lady gave me one e-mail address and asked me to send a e-mail to them regarding this matter. Can anyone tell me that will this mistake of mine considered by the Home Office or what could be their decision?

Thank you
