Nottingham university is enough to show them ur English proficiency test ... As all UK degree are taught in English.

I think you can simply check if your degree is qualified by using point-based calculator. Most degrees are included as Shahkakaram mentioned that all UK degree are taught in English.

Thanks for your advices, I have checked on point-based calculator, with my degree from where I graduated in Nottingham Uni, I do have 10 points for English language. Usually it's the other way round I believe. .

Yes strangely I did get the BRP today and still waiting on my documents.
I called HO today again on 0151 number and been given the Royal Mail tracking number but it's not working.
Don't know how to check where my documents are as by HO they were sent out yesterday.

Bro..
When u called yesterday., they told you the documents will be dispatched today or tomorrow right.,
So for you to get the brp today it should have already been dispatched although the guy says not done yet.

When u called yesterday., they told you the documents will be dispatched today or tomorrow right.,

Yes that's right. But on the BRP issue date is 04/03/14 so I guess that's when they posted the documents I believe.i know for sure that dx does the delivery next day.

But what I don't understand is why this tracking number for Royal Mail does not work? And why Royal Mail is taking longer?

Probably, you will not see the track but it will be deliver to you Tommo or Day after Tommo. after deliver you will see, it has been delivered !

My sincere gratitude to the organizers and coordinators of this forum. I have done my time and here is my timeline:

Application sent: 23/10/2013
Payment confirmation: 29/10/2013
Biometric enrolment invitation: 17/12/2013 (letter sent 06/12/2013)
Approval confirmation: 27/02/2014 (delayed because it was sent on the 18/02/2014 to my old address)
Biometric card arrived: 04/03/2014 (delayed because it was sent on the 19/02/2014 to my old address, then redelivery scheduled etc, etc..)

Application based on 4 years student, 1 year IGS (the old type post study), 5 years student, and existing visa until autumn 2014.

First and final question for the members of this forum: would anyone be able to share a link that explains the naturalization procedures (after 12 months if I am correct) for people in this specific category (10 years long term residence).

On 08 May 2007 you made a further out of time application for further leave to remain as a student. Your representative’s covering letter, dated 02 September 2013, claims that this application was accepted as in time application referring to an erroneous note made on our internal system, that you obtained following a Subject access request in May 2013. It is noted that after submitting an application on 08 May 2007, that was 81 days out of time, you were subsequently granted a period of leave to remain as a student on 01 June 2007. This was because Immigration Rules for leave to remain in that capacity did not require that applicants have extant leave at the time of application. Further in your case, as you were granted further leave to remain in the capacity of student, it should be noted that this is a category that does not of itself lead to settlement. It should not therefore, be inferred that as leave was subsequently granted in your case that this raises an expectation that any future application on the basis of long residence would see the requirement to have spent a period of 10 years lawful continuous residence in the Uk waived.

With this in mind, you were without valid leave from 17 February until 31 May 2007, a period of approximately 104 days. As such your period of continuous lawful residence is considered to have been broken at this point.

Therefore you cannot demonstrate 10 years continuous lawful residence in the Uk and cannot meet the requirements of the Immigration Rules with reference to Paragraph 276 B(i)(a)

I talked to an oisc immigration adviser yesterday and found out:

I got a very strong argument that it was 28 days and not 31 days

Basically from the long residence guidance, the The 28 day period of overstaying is calculated from the latest of:

the point that a migrant is deemed to have received a written notice of invalidity, in line
with paragraph 34C or 34CA of the Immigration Rules, in relation to an in-time
application for further leave to remain.

Deemed to have received according to Immigration rule is the day after except if it was a business day

On my Sar, it is written that outcome was finalised on 16 feb 2007 and was dispatched to me on 16 feb 2007

Based on Immigration rules above:

I would have received notice of invalidity on 19 feb as 17 feb was a saturday and 19 feb to 19 Mar is 28 days as feb 2007 was only 28 days

so that the app was returned within 28 days and not 31

Now that this has been covered, my main issue is the subsequent apps that were rejected. All of them were returned in time but I dont know if that will have any effect on my case.

Can somebody please help me on this?

Based on the argument above, can i apply for a reconsideration side by side with my appeal?
Bro, I am also having same problem. Just let me know what was written on ur sar note when u got ur visa after all this problem. Is it valid in time or valid application and 104 days out of time

Me and my Daughter came in UK on 16/July/2004 as Visitor Visa (Mean 6 Month Visa Tourist). My first Daughter is 10 Years old now who was born in Mauritius, she came after 3 Months, Second Daughter is 7 Years old Born in UK in Sep 2006. I lost One Daughter 2 Years ago (Still Born Baby). :(
We convert our Visitor visa as Student Dependant Visa on November 2004 till Now, as my husband is here since October 2003 as on student visa till June 2014.

My queries are I got 35-40 days Gap for making the 10Years application. Our visa is run out on 06/June/2014. (Me and my First Daughters came on 16 July 2004).

1. What is the best way to apply?
2. Which application we need to make?
3. Which Document need to provide?
Please answer my queries. I will appreciate your help.

I am not expert but still learning from this forum.but what I know for sure is that you can apply 28 days before completion of your 10 years .means if you came here on 16 July then you can apply around 20 June .hope some one senior member will help you also.my hubby apply exact 28 days before and got ILR without any problem.

Ur all passport to send along application u had in 10 year
Life in uk pass certificate
English requirement at B1 level( if u done any degree in uk then u dont have to pass b1 ( ur original degree certificate will fulfil english requirement ,
If u have degree from ur home country , u have to send to to Naric to get their confirmation if ur degree satisfied B1 level of english.
Some people send other documents like, utility bills , bank statements etc.... But it is not necessary
I would suggest u to read through long residency guidance

English requirement at B1 level( if u done any degree in uk then u dont have to pass b1 ( ur original degree certificate will fulfil english requirement ?
