A big thank you to you all. Just to confirm can they stay on as pbs dependents until this change as far as it is valid? Also is this continous residence of 2 and 5 years apply to them once both of us have our ILRs?

You need to keep checking the statement of intent each time they are published.

If this happens, those PBS dependants whose spouse were not on a PBS route to settlement (I.e, settled as a long residence) will no longer by able to use Part 8 (2 year qualifying period) nor will they be able to combine the time as a PBS dependent with that of flr(m).
sorry amber my question was in refrence vto this particular post. thank you

I am posting a question on behalf of my friend.
He came to UK on student visa in 2007 and got married to British women same year but never changed his status and presently still on student visa and doing Phd. If he applies for settlement now, what scenario will be applicable for him. Please reply soon. Thank you.

He may switch to FLR(M). He will be under the current rules. However, he cannot apply for settlement at present. Possibly apply for SET(LR) in 2017.

That is, again, subject to a change in the rules being implemented, correctly this time.

Hi Guys

I came to UK in 2004 as a student and am planning to apply for ILR in June.
My wife and children(all born in Pakistan) joined me here in 2006 and are with me since then.
I am still a T4 Student.
My questions...

1- Which form i should use for my wife and children (FLR(M)?)
2- As she is a T4 dependent and living with me from last 8 years in UK do i need to meet financial requirements for her ?

Many Thanks

Dear senior members, i have got my ilr through 10 years route and right now preparing my wife flrm. I know old rules apply to her as she has been my pbs dependent before 2012. As i m doing private hire, so i don't know how to show my source of income as i can't provide wages or payslip. Also money is not going in regular intervals in my account. Please give me your kind advice.

So you are self employed. Have you not been doing your self assessment or tax returns every year? I am sure you did, these tax returns or self assessment statements are proof of your income. You can say that you get the income yearly as in self assessment you mention all your expenses and stuff like these and you then tell HMRC how much you have earned and how much tax you are paying. So the earning after deductions, i.e. Tax and National insurance contributions is the one you'll provide.

B1 English should satisfy both FLR(M) and SET(M), for SET(M) LIUK is also required. Proof of cohabitation and 3 months wages slips and corresponding bank statements.
Dear Amber,

Could you please provide the HO rule as for reference.

Many THanks

Hi all, hoping to get input from amber and members
I have received my ILR yesterday, and wanted to know as i have asked HO to not process my wife's FLRM application until mine decided , also in cover letter i wrote to inform HO about the outcome of my application,
Do you think i should inform them now so they can start processing her application , or would they know any way from thier internal system?
Also regarding accomodation we have wrote shared accomodation and also a letter from land lord that im residing
In the property with my wife and also my brother lives at same address , this was only bcoz the tennancy agrement was under my brother name, in rent box i have put 350 even tho the total rent is £780 , will it be fine
(im actually contributing above amount towards rent by standing order)
I know its late to ask question as we alteady applied
Do u think i did it right, is it how it should be ?

Apply for FLR(M) before the rules change.

If you're granted leave under part 8 of the immigration rules your waiting period would be max. 2 years.

hi Amber,
I have read through this HC1138 (page 9 7.11). My understanding is that every one who gets ILR (LR) their depends will apply via Flr(m) but important thing is that it does not say any thing about transitional period for dependants so I believe that transitional set up is still in place all we have to do is apply for Flr(m) then SET(m). Our dear friend sswsz is one of the lucky ones who got her ILR straight away. please correct me if I m missing any thing here.

please please explain this to me this reall matters.
