ILR Eligibility

Post by MV11304 » Sat Mar 08, 2014 10:51 pm

Hi,

I have written my case below. Please advise whether I'll be eligible for ILR by 15-Feb-2015.

Visa Status:
Tier 2: 26-Jan-2010 to 26-Jan-2012
Switched to Tier 1: 19-Jan-2011 to 19-Jan-2013
Tier 1 Extension: 15-Dec-2012 to 19-Jan-2016 (current)

My current Tier 1 visa expires on 19-Jan-2016 but my residence in UK (including Tier 2 and Tier 1) will be 5 years by 4-Feb-2015. Below is the break down of my entry and exit in the UK (considering my application is on 15-Feb-2015):

Year 5 Period: 16-Feb-2014 to 15-Feb-2015
Business Trip to US - 15 days (Salary was paid in UK)
Holiday - 9 days

Year 4 Period: 16-Feb-2013 to 15-Feb-2014
Business Trip to India - 30 days (Salary was paid in UK)
Holiday - 24 days

Year 3 Period: 16-Feb-2012 to 15-Feb-2013
Deputation to India (Offshore) - 67 days (Salary was paid in UK)
Holidays - 8 days

Year 2 Period: 16-Feb-2011 to 15-Feb-2012
Deputation to India (Offshore) - 300 days (Out of this 60 days salary was paid in UK and remaining days salary was paid in India from the same employer)

Year 1 Period: 16-Feb-2010 to 15-Feb-2011
Annual Holidays -30 days

I have exceeded 180 days limit in Year 2, but that was on business trip and was fully paid. Will I be eligible to apply for ILR? Please advise.

Thanks.
