Hi

I am a Non EEA family member in the UK and I am currently under EEA 2 which expires in 2017

I would like to bring my father who has started becoming financially dependent on me. He was dependant on my sister till she lost her job

My plan is to send him funds for the next three months (I already sent him £400 in Feb) then apply for an EEA family permit.

I found a list of required documents here

My question is he is currently staying in his own house but his bank statements show that he has no physical income. So how do we prove that the money I send him is being used for food since he is not paying accommodation?

See below a paragraph from the home office website

EUN2.9 How do I establish dependency under the EEA Regulations?
Direct family members must be wholly or mainly financially dependent on the EEA principal to meet his or her essential needs in order to qualify for an EEA family permit, (children under 21, spouses, civil partners do not need to provide any evidence to show dependency on the EEA national).

Extended family members must be wholly or mainly financially dependent on the EEA principal to meet his or her essential needs in order to qualify for an EEA family permit (durable partners do not need to provide evidence to show dependency on the EEA national). Emotional dependence to the EEA national would also be expected in order for an extended family member to qualify for an EEA family permit.

Whilst the following criteria are not in themselves grounds for refusal, they should be taken into consideration when assessing dependent relatives:

Whether there are any other close relatives in the country of origin from whom the family member receives material support. If a family member receives funds from the EEA national but, for example, is living in the same household as another relative who provides their food and accommodation, the family member cannot be said to need the financial support of the EEA national in order to meet his / her essential needs.

Whether the family member leading an independent life. For example, if a direct descendent 21 or over is married (and especially if they have children), it may be questionable as to whether the EEA national is supporting the essential needs of both the family member and their spouse and children. In such cases additional attention should be paid to ensure that the financial essential needs of the family are being met by the EEA national.


So other than the receipts of funds transferred how else can I prove financial dependency because there does not seem to be any clear indication

And is 3 months enough to prove dependency?

Hi there,
In 2010 I had the same problem like u have now, but my mum was very ill.
i had applied for her visa on our country, however, was refused. i brought my mum here as a visiter and then i applied for her visa, 3 months later the HO granted her 5 years visa.

Thank you micky but with all due respect that sounds a bit sneaky. Why were you refused out of interest, I thought the health of the parent were not grounds for refusal since they are a direct family member?

Let me tell you my story. an offic-a will not look into your application while he/she is busy to bringing it to 'tens of thousands" of new immigrants to UK. it doesn't matter what you inclose, they will refuse, either based on the above or simply based on being under-qualified for any other work, so life is a bi@tch and they will let you find out it for yourself.

so lets be normative here. prepare a good bundle of all document and a cover letter. lets be clear - an entry clearance offic-a is a sine non qua dummy, so make it very, very simple for him/her. this is despite knowing of imminent refusal. Then you will apply for appeal. get a good barrister, use social capital to ask friends around. immigration specialist contacts are shared between good friends. and document every failure of ukba.

did i paint a bleak picture? not at all. this costed me 1.5 years and some money. we will go to a second appeal after a second refusal on stupid grounds. but hey, give them a chance, they are virtually useless anywhere else.

so what were the refusal grounds, if I prove dependency what else could be the refusal grounds?

Guys I really need help here is 3 months enough to prove dependency? Should I hold out for 6 months? And is it bad that my dad owns the house he lives in? He has no source of income other than myself now so he is fully dependant on me.

Anyone had a similar case?

impossible but you can try. I've seen even 9 month dependency UKBA refused.

your case is 30% chance of successful ... try it you may be lucky

What makes you say that? Have you tried applying yourself or know firsthand of a similar case?
