British citizenship for child in India

Post by akira » Tue Mar 11, 2014 10:28 am

Hi,
Me and my husband are applying for our Naturalization this week through NCS.
We qualify based on HSMP 3 year + Tier 1 general 2 year + ILR + 1 year stay criteria

We got our ILR in Jan 2013 and our child was born in India in April 2013. She is currently living in India and doesn't hold any Indian passport or visa.

We are planning to bring her to UK and was wondering what is the best way?

1. Apply for Indian passport, then settlement visa.

2. Once we get our British citizenship, apply for her citizenship/registration as a British Citizen directly and then get an OCI.

My understanding is if we go for option 1, she has to stay in UK for 3 years before she gets british citizenship.

If we go for option 2, is she eligible for directly applying for registartion, after we got our British passports?
If so, can we do this from UK(note that she is currently living in India with her grandparents)?

Which process is of less hastle?

Please help.

Many thanks,
Akira

Check the FAQ (link below). Scroll down for the children section.

It's only option 1 and then 2. She will need to live in the UK first (on a settlement visa) before applying for BC. It doesn't need to be 3 years (the 3 years are for children born abroad to parents who were British at the time of the child's birth).

Hi,
Many thanks for your reply.Since we are applying for our Naturalization now,if we can skip option 1 i.e not apply for Indian passport/settlement visa , can we directly apply for her British citizenship/registration once we get our British Citizenship?
Many Thanks
Akira

She is expected to live in the UK if applying to become a BC so she will need a passport and an appropriate visa to live in the UK.
