Hello friends and senior members on this board

Here is a good news i got my residence card today
Here is my time line

(1) EEA 2 application send on 15/04/2013 as a unmarried partner
(2)Application refused on 02/12/2013 with right of appeal(reason is my partner not exercise treaty rights)
(3)Appeal and reconsideration request made on 11/12/2013
(4)Appeal hearing date receive on 18/01/2014 its 30/07/2014
(5)Call to HO regarding my reconsideration request on 19/01/2014
(6)Reconsideration request accept letter receive dated 22/01/2014 (for submit new evidence for treaty rights before 05/02/2014)
(7)Submit new evidence and other documents on 03/02/2014
(8)Today I receive RC dated 26/02/2014

This is my time line good luck for every body who going to apply or waiting for RC ..... 8)

Hey all,
We need your help urgently.

My wife is a non-eu member and has applied for RC using EEA2 form on 10th Dec 2013. I'm a Lithuanian citizen.
Payment was taken on 13th Dec 2013, COA received 6th Jan 2013.

Today we received a refusal on our application stating that the eu-member (me) "have not provided sufficient evidence that they are economically active in the united kingdom at the time of your application".

This is a huge disappointment and we're really upset.

I moved here in August 2013, and started working as self-employed. We got married in September 2013 and my wife has moved here in November 2013 after receiving an EEA family permit.
Apart from the form we have added my EU I.D, my wife's passport (with the EEA family permit), our originally marriage certificate, gas bill (proof of address). To prove that I'm exercising treaty rights in the UK as self-employed all I was asked according to the document guidance was to add Tax Return/Ni Contributions etc. I've add my first (and only, as of yet) NI contribution which I've paid plus an additional 2 invoices and 2 receipts. I've also attached our personal bank statement with saving of thousands of GBP.

I can't seem to understand why it was refused!

I called the Home Office earlier today and spoke to an adviser who didn't really understand why my wife's application was refused so she decided to contact the lady who worked on the case. Within an hour she called and told me that the lady who worked on the case stated, that whilst they accept that I have provided NI contributions class 2 payment, my invoices and receipts are in handwriting, with names only and without any addresses so they cannot confirm if I did actually receive the payment. They couldn't see transactions on my account of the payment and also they said that I haven't provided any business account statement.
This is just ridiculous! I'm working as a private teacher and as stated on the invoices and receipts that i've added - I've received the payments in cash, so I obviously I don't go and pay every small amount into my band account straight away. The invoices and receipts I've used are legal in the UK and you buy them like everybody else from WH Smith, there is no room for address and they expect me to add printed invoices! Plus- I don't need to have a business account.
It's not my fault that this is how I'm getting paid. I'm doing everything according to the law and did provide them all evidences to prove them I'm exercising treaty rights (although I think I only had to attach paid NI contributions!)

On the bank statement provided there were actually few transaction from one student who does wire transfer directly to my bank account but they decided to ignore it.
I feel like they just decided to refuse it so we would pay more money and appeal. It is just rude- there is no real ground for the refusal.
We're both very organised and we've read and asked dozens of people before applying to make sure everything is with accordance to what the HO want.

I've called the EU and opened a complaint and I'm thinking to file a complaint against this lady who worked on the case.

What should we do now guys? we're quite lost!
Should we appeal (oral hearing or papers)? Should we re-apply? What can I do differently? Should I wait until I fill my first tax return (self-assesment) next month?
Can I ask them to re-consider it?

Hi everyone I have received my RC today. Just wanted to post my timeline.

(1) EEA 2 application send on 06/12/2013 as a married partner of an EEA citizen currently studying in the UK.
(2)Received COA on the 31/12/2013
(3)Received RC yesterday (05/03/2014) dated for the 28/02/2014

The whole process took less than three months and was almost hassle free. Was expecting an interview or a visit none of them materialized.

Good luck to everyone waiting and thank you to all the members on the forum who have helped me along the way answering my often silly questions.

Hi there,
Well well here we are now, and here is my timeline
Got married on 27th of Dec 2013
Application sent 8th of January 2014
application received 9th of January
payment went through 12th of jan
Confirmation received 15th dated 13th
Coa received on 17th dated 15th of January with work.
Rc?? Still waiting
After reading all the comments I decided to share my story! !
Well on 27th of oct 2014 I been detained by an emigration enforcement team as I was overstayed for more than 1 year on student visa. After explaining my story and with my girlfriends help I came out of detention center after exactly 7 days. But my passport is still retained and when I sent the application I didn't send my passport as its still retained. But my solicitor did describe this on a separate covering letter everything about what happend to me and what I have been gone through.
Now am soo scared and worried that don't know what's gonma happen how they gonna deal with my case.

when i read replies saying it all went ok and fast i get happy. when i read some that had problems i start stressing out :)

I'm Romanian, blue card holder since 2007 with no restrictions, my husband is Serbian. We got married in 2012 and had a baby in September 2014. My husband joined us on the baby's birth after receiving his family permit. I am self sufficient depending on my husband's income as self-employed. Could not send the application over earlier as my husband had to take some more courses and also we moved from where I used to live and a lot has changed and we also needed our documents for other things and so could not apply for a lot of reasons. My husband is registered as self-employed and NI class 2 contributions since 01-01-2014 but hasn't started work until 13/02/2014. As soon as we got his first money in the account we sent the application with all the required documents. We have no proof of NI contributions paid for him.

03/03/2014 - application sent
nothing until now.

I hope they'll send us the CoA soon! as he is having trouble with his job now. they asked to prove he sent the docs to HO. I sent them the post office receipts and the checklist of the documents photocopied. they haven't replied and i hope it will be ok as soon as his family permit expires and he won't have to stop work if his CoA doesn't arrive by then.

will the HO go down if my husband didn't send them proof of NI contributions?

what other way is there to prove he has a right to work if his CoA doesn't arrive by the time his visa expires?

Rc: ring on friday , finally they said your application is decided and it is in the security check then despatch so check with representative next week, I ask if you can tell me the decision pls , the guy was nice and he said YES you are issued with visa for what ever you applied for ...so now I hope for the best .

I think they have started December 2013, the wrong way around. :)

We sent off on 09 December. 2013
CoA received (with permission to work) some time first week in Jan 2104.
So we must be near the top of the pile now I hope.
I have been told they do the applications in "Strict" date order of received.
With that "Strict" date order of received, I am not sure they are telling the full truth, and that some do get processed which are not in proper date order.

this is my time line


12/12/2013- EEA2 applications sent (unmarried partner)
13/09/2013- applications received by HO
16/12/2013- Payment Deducted
06/01/2014- COA received with no right to work
07/03/2014- called HO Application Alocate to case worker still in processing

i can see that December application is now being dealing with.

For me and those who are waiting for decision, H.O will favor us with resident card that we want.
In the name of our god that we believe in.

i will update you what next by name of god (insha allah )

I got visa yesterday , so my timeline is
Apply:15 Augest
Coa wid no right to work .
Interview:16 January
Rc :stamp 5th march but received on 13rth March.

This is soo bloody quick I mean no offense against you am jus surprised.
I sent my application on 8th of January but still I only received Coa witg right to work but no rc. Am sure there are some people waiting from last year to receive their response.

Hi Guys

This is an interesting forum.

I have sent my EEA2 (Unmarried) on 7th Jan 2014
COA received on the 15th Jan 2014 (No right to work)
was on unpaid leave for almost 2 months now,, and might lose my job if they dont send me a COA with right to work or the RC by mid April.

I don't know about you guys, but i find this so ridiculous and unfair. Preaching about Equalities and Human rights is one thing, applying it fairly is another. If someone gets married after one month of meeting their partner will have automatic rights, but unmarried partners who have been together living and working in the UK for 4 + years dont have the right to continue working...weird and unfair stuff!

Some of you had mentioned about interviews... is it part of the process that they will call applicants for an interview? I hope they'll ask for an interview from me and my partner,,, i think it will help speed up the process!
