Hello everyone,
I hope you can help me.

Here is my timeline:
EEA2 Married route
Application Sent: 12-02-2014
Received: 13-02-2014
Payment deducted: 14-02-2014
Acknowledgement Letter Dated: 14-02-2014

I can see very similar applications that already have their RC, and in my case,I have not received even the COA...
Do you think is normal so late in the COA? and what could be the reasons for the delay?
I'm starting to worry.

If several weeks have elapsed since you submitted your application, and you have not received your COA, you can phone the European enquiries contact centre to check whether they have sent you a certificate.
Call using UKBA NUMBER 01516725626, it's the number where the 0845.... calls are redirected to, but at least they won't be as costly.

Hello guys, i would like to share with you today a great news made me over happy , i got my residence documentation on passport
i've applied as married route to a polish nationality , as worker

here is my time line:
18/01/2014 sent
21/01/2014 received by home office in durham
22/01/2014 fees deducted
29/01/2014 received COA with right to work
10/02/2014 received the application letter
i have sent them 2 times recent payslips of my wife and a new permanent contract with her company
20/03/2014 received my residence dated 13/03/2014

good luck to everyone

Don't worry mate you'll be fine. Call them some other day and I am sure they'll tell you the status. Not all the operators are same like the guy you described above. I called them quite a few times and they told me the status of my app.

Keep me updated, hopefully we'll hear back from them In next 2 to 3 weeks:)

hi

I called home office monday and they told me that a decision has been made.
yesterday I called for trackingnumber and the lady told me
no decision has been made.
the case worker called wife employer a week ago.

dont know what to think...

by the way congratz to them who received RC.

Congratulations once again :) but I'd like to know the reason why you had to send recent payslips. Did you actually applied as your wife being self employed and later she secured a job as employed? Please clarify

well my wife is a employed as worker in a company , i took the advice of updating the home office from one of the member of this forun , so they could see that she is excersicing her treaty rights , so this is why i was sending them

hello everybody, i have a question , we have a wedding to attend in poland , do i need a visa to go to poland , because my wife will fly before me and i will be joining her , i read on polish embassy website , but it is a bit confusing , so if anyone knows if i need a visa or not please let me know asap

Well as far as I know yes u do need the visa to travel to Poland even tho you're a family member of an eea national or she is holding a polish nationality.
Or may b am wrong or u can google this topic or may b somebody els can help u here

Hi Guys,

Thought i'd share my experience with you and get some useful advice.

My mum and dad arrived on a tourist visa in sep 2013. My mum has always been dependent on me Dad but before coming to the uk Dad retired and joined us in the UK.

We applied for EEA2 in jan 2014 below timelines-

Applied: 14/01/2014
COA received: 22/01/2014 with right to work
Sent more documents proving dependency: 28/01/2014
Again sent more documents of dependency:18/03/2014
Refused: 19/03/2014
Documents received: 22/03/2014

Caseworker refused the application solely on the fact that they are extended family member and proof of dependency doesn't exist prior to entering the UK???

I'm married to an EU national and both of us are in full time employment. Myself and my wife is supporting them.

Can someone please shed more light if UKBA are correct in refusing on the basis of extended family member? Thought my mum and dad are direct family members??

Please help.

You do need to prove dependency for your parents (even if they are considered direct family members), e.g. by way of financial payments to them when they are in their home country.

"EUN2.6 Who are an EEA national's core family members?
The family members of an EEA national (part 7 of the EEA Regulations) include:
spouses or civil partners;
direct descendants of the EEA national or their spouse/ civil partner under 21;
dependent direct descendants of the EEA national or their spouse/ civil partner 21 and over;
dependent direct relatives in the ascending line, for example parents and grandparents of the EEA national or their spouse / civil partner.
Financial dependence should be interpreted as meaning that the family member needs the financial support of the EEA national or his or her spouse/ civil partner in order to meet the family member's essential needs in the country where they are present - not in order to have a certain level of income.

Important:
If the applicant is the spouse or civil partner of the EEA national or a dependent child of either the EEA national or their spouse or civil partner is under 21 then they do not need to provide evidence of financial dependency and therefore this should not be requested from the applicant."

Thanks for your reply. However we've proved dependency for the past 5 months since they've been in the UK. I.e transferring funds from our account to my dad's bank account here in the UK.

For the direct family members I don't think we need to provide dependency prior to entering the UK? circumstances changed no job to go back to and no house back home.

But my question still stands are my parents considered as extended family members or direct ?

As noted on the website I linked to above (marked in bold): your parents are considered direct dependents.

Re: Dependency before coming to the UK, I'm not sure. Hope someone else comes in and gives some ideas about this.

This is an issue with having your parents enter on a visitors/tourist visa. If they had applied for the EEA Family Permit from their home country, you all would have had a better idea of the requirements. Any reason why they didn't apply for an EEA FP? Or are they non-visa required nationals?

So caseworker is wrong in establishing the relationship as he considered my mum and dad as extended family members - for which you DO need to provide proof of dependency either in same household or prior to entering UK.

They are visa national . They had tourist visa issued in 2011 for 5 years.

While I was writing this, something just came in my mind thought I'd put in words, imagine a non visa national (eg US citizen) got retired in States and he/she joins his son in the UK who is married to EU national and working full time and the direct family member stay for 5 months and has no property or savings whatsoever in USA. And the couple is looking after him/her. How would UKBA go by this?

It's the same scenario except my mum and dad are visa national.

Ok that's great information from everyone.
And let's create a scenario am a member of an ee national and I have got eea2. Lets suppose am working full time and my wife is working full time. So is that mean I can call my brother or sister or even parents to come to the UK being a member of an eea national or his/her spouse's family member?

Brother & sister and so on comes under extended family member and to some extent different approach.

With regards to immediate family members I.e spouse/ kids/ parents under one umbrella but for parents proof of dependency.

My question is : has case worker rightly refused my parents application taking consideration as an extended family member rather than direct??

I send certificate of opening limited company, invoices, bank statements, letter from accountant, house rental agreement, gas and electric bills, national insurance payment bills for last year
please which periods did your documents cover, is it for the entire period of marriage.

hi ever one i applied for my wife EEA2 been refused with passport held ,
i have czech passport
my wife have czech travel document
we have child
ressone for refused is that iam not quilefy person , i did apeal and wating the answer , i sent them evedence of my JSA . letters that iam regesterd in job agencies . letter that iam attending a work programs semd them my child birth certificat even befor the appeal i sent the tenanets agrement with me amy my wife names ., marriege certificats . we are her in uk more one year and when i didi asked the ukba do i have to apply for her a EEA2 they tolf no you dont need as far as she live with you cos its not must.
after they refused her application they sent a letter telling her to leave the uk .
but i will fight them as she has the right under eeu law as a member of eeu and iam the first clase relative to her husband
any one plze tell what to do as iam waiting the appeal
