Switching Tier 1 General to Tier 2 General

Hi All,

Hope someone can help me out this. I have applied my Tier 1 general extension and it was refused and I decided to appeal. I had hearing on 26th February and I received my decision on 10th again with appeal also dismissed. :( . I have decided not to apply high tribunal and return to country.

However, My employer is willing to sponsor me and they have A rated certificate. Can I switch to Tier 2 with in the country? Because my Visa was expired 14th May 2013. Do my company need to take resident labour market test?

Would be great someone can help me out. I think I have 28 days to return.
