Hi
I am ilr holder(got from tier1) and applying for wife who join me in 2011,current she is on flr m ,
got two kids, wut will be maintenance requirement or salary requirement to apply with her set m application,
and if she apply with SCS(council) can she travell as her passport will be wth her.

There is no financial requirement .i attach 4 month bank statement and payslips of my hubby .english requirement and life in uk is the main requirement with address proof and got ILR without any problem. Yes she can travel if she use NCS

MY SOLICITOR SAID I NEED SAME LEVEL OF SALARY AS I SHOWED IN MY ILR , I AM SALARIED AND SELF EMPLOYED,DO I NEED ACCOUNTANT STATEMENT OR JUST PAYSLIPS FOR MY SPOUSE ILR ?

I have no idea about set(o) form but if you are applying for your wife on set(m) then u just need atleast 3 month statement and payslip.
My hubby is also employed and self employed I attach 4 months statement and payslip ,accountant letter and hmrc unique ref num letter but my case worker after discussion and some confusion said that I came under old rules then she is only interested in payslips and didn't consider account letter and self employment

many thanks for ur reply,
when did u applied ,did u applyed by post or peo ? how much was salary did u showed on payslips? my wife came in 2011 ,we got two kids ,one got ilr another naturalised as british,so m planning for peo ,does my payslips should be ok ,bit confused .

I applied in Croydon peo on 3 feb 2014 . My hubby total income after deduction is 18000 . I am in uk since 2006 . Have 3 kids but never applied for their ILR as I apply for their bc. Don't worry u will be fine as for ILR their is no special financial requirement for before July 2012 applicant .

They didn't ask me any question when I showed them mail which says I come under old rules then they simply gave me visa.

actually they arguing with me that i have to show income threshold according to their perception as i am going to apply for flr on that day they will consider me as new spouse applicant or you can say first time dependent applicant and due to this my hubby earnings proofs are not sufficient ,but when i show them mail they went inside discuss with senior and issue me flr then set m same day .and after they agree that new rules never applied on me they said we dont need any more proofs for income just pay slips and bank statement is suffice.if you came under new rules then the situation becomes complex otherwise their is no such thing as some specific income .

1. If a person has been granted ILR on the basis of 10 years long residence, their spouse can no longer be considered as a PBS dependant, and they must apply for an extension of stay as the partner of a settled person on application form FLR(M). A person here as a PBS dependant would not be able to meet the settlement requirements of the spouse rules if they were to apply directly, without first applying for limited leave to remain on form FLR(M).



2. As long as the spouse was granted leave to enter or remain as the dependant of a PBS migrant prior to 9 July 2012, then the spouse can be considered under the transitional Part 8 rules for further leave to remain as the spouse of a settled person under Paragraph 284. These Part 8 rules do not include the Financial Requirements (including earnings over £18,600) you have mentioned, however they do require an applicant to be adequately maintained and accommodated without recourse to public funds. 3. A spouse can combine any leave as a PBS dependant with leave as the partner of a settled person granted under Part 8, to meet the qualifying period under paragraph 287 of the Immigration Rules, which is 2 years. 4. A spouse meeting the above requirements can consequently apply for settlement at any point after they have competed 2 years in a combination of these 2 categories (PBS dependant and spouse of a settled person).

Dear SSWSZ and all,
I m very confused about my wife ILR, so need ur kind advice/suggestion.

My wife came to UK on PBS dependent visa in July 2011.
She extend PBS dependent visa for 2 years(06 Dec 2011
to 06 Dec 2013).
I got my ILR NOV 2013(5 year route)but my wife did not apply bcz of KOL requirement although she had already completed 2 year probation period.
After completing 2 year on PBS visa she applied for
FLR(M) as a partner of a settled person and got it it dor 2 years(06 Jan 2014 - 06 Jan 2016)
Now ahe meet KOL requirement but I m confused whether she comes under the new rules or old,

I will be very thankful if any one can guide me

As she got 2 year flr m it means she is under old rules now you can apply for set m any time either peo or postal upto you .
