Its upto you but as far as i m concern there is no point calling them as they will give you the standard reply of ''under process''.

Hi everyone

I have applied ILR on basis of 10 years rule on OCT 2012 still waiting for decision. My solicitor applied for my family leave on flro form , Home office refused with right of appeal, First tier judge allowed appeal, now my family received visa just our solicitor informed us today. I have question here if I will get ILR still my family can apply ILR on basis of dependent because they were tier 1 dependent last four years and going to complete ten year next year too. A bit confusing situation now they are on DLR on basis of 7 year child / family / private life.
Your views and discussion will be great.

I hope it is true.

I will try and update some details, if you want to know anything in specific, feel free to ask,

Guys, really sorry but I haven't been keeping track of exact dates but the main dates are true [i.e. application sent and docs received]

Application sent - 07/12/13
Acknowledgment Letter - within a week
Bio-metric Invitation - December last week
Bio-metric done - January first week
Documents received - 21/03/2014
BRP - waiting

2002 - 2007 Student Visa
2007 - 2009 IGS
2009 - 2012 Tier 1 General
2012 - 2014 Tier 1 General

I could have applied for ILR in Sep 2012 but I couldn't let go of my passport for that long so I got an extension on Tier 1 instead.

All in time applications and had a refusal on Tier 1 when I first applied due to insufficient funds. I had the funds just didn't send correct paper work. Fortunately I still had leave to remain so I applied again and got it.

That's all I can think of to be of any use, rest was fairly straightforward I guess.

Like I said, if you have any specific questions, feel free to ask.

Appendix FM family members Document saying ....on 2nd page of APPENDIX FM

"This Appendix applies to applications under this route made on or after 9 July 2012 and to
applications under Part 8 as set out in the Statement of Changes laid on 13 June 2012 (HC
194)."

So its mean the minor change will be that from 06 April 2014 PBS dependent cannot apply SET(M) directly (as SSWZ and other our board members did). They need to apply FLR(M) 1st (means through Appendix FM). Because Appendix FM also apply on PART8.

Please correct me if am wrong.......

Transitional Provisions


1. Introduction

"With effect from 9 July 2012, the Immigration Rules have been amended to
introduce new requirements, including a new financial requirement for those
applying for leave to enter, leave to remain, further leave to remain and indefinite
leave to remain in the UK as a family member.

From 9 July 2012, Appendix FM and Appendix FM-SE of the Rules apply to all
applications to which Part 8 of the Rules previously applied to on or before 8 July
2012 except where the provisions of Part 8 are preserved and continue to apply
as set out in the Statements of Changes to the Immigration Rules HC 194, Cm
8428, HC 565, HC514, HC 760, HC 820 and HC 1039."

some people done directly set(m) through shefield centre but that was luck , actual current rule is flr(m) then set(m) but still confused about new upcoming rules....lets see....

But the question is if PBS dependent will have to apply for FLR(M). Would they be able to exercise transitional arrangement and apply for SET (m) after getting FLR (m)....

Yes. Your wife may apply for FLR(M) (with a covering letter asking for decision to be deferred until after your SET(LR) is decided) by registered post before 6th April 2014.

I compulsory documents I sent were

passports
2xUK degree certificate
life in uk test

in addition I also sent

marriage certificate
House ownership documents



I really struggled with some of my exact travel dates, they didn't even have all my travel dates in SAR so I guessed and exolained it in covering letter.

I did have 3 points in my licence which were cleared few years ago but I declared it anyways.

I had leave to remain on my old brp so it could be just that which may be coming back. My friend got a letter saying his application has been approved.

If FLR (M) application sent before 6 April and granted after 6 April would the applicant eligible for set (M). Entered UK 18 jan 2012 as a PBS Dependent.

Yes vinny, i have looked that, but its not clear .

We all want to know that if we apply before 06 april and get FLR(M) after then do we need to wait 2 years, 5 years or can apply SET(M) straightway?
if we will wait for 5 years for Settlement then what will be difference if we apply before 06 april or after 6 april?

Thanks Palmist... don't worry hope for the best..Inshallah u will hear good news.. Normally approvals had quick response and Rejections were released after 6 months. It must be approval..
