Hi All,

Looking for an urgent response. Much appreciated.

I am currently on Tier 1 General Migrant visa and am going to apply for ILR .

I have NOW completed exactly 5 years (Work permit + Tier 1 General Migrant + Tier 1 Extension)

my current Tier 1 extension is going to expire Next year 2014.


QUESTION??

Question is for my wife ;;; Because of the change of My status in UK (as i mentioned above, i am applying for ILR)?

My wife is currently on Tier 1 dependent Visa (expiring in 2014).

As i am applying for ILR now (after 5 years completion from Work Permit+Tier1+tier 1 extenion);;;;

what will happen to my wife's visa status? Does she need to apply at the same time with me for some other visa (if yes, which visa?? ILR?? ) OR does she need to wait for her current leave as Tier 1 dependent to expire in 2014 and then apply? if yes (which visa at that time)

What is the next step for her?

If your wife has completed the residential requirement for ILR(which is 2 years), you can apply for her as well.
-HSMP(2008)->Tier 1(2009)->ILR(2013)->Naturalisation(2014)->OCI(2014)-

My wife got her Tier 1 Dependent visa last month and it will be expiring in Line with my current leave (Tier 1 General) in 2014

Your wife does not need to do anything - she can remain in her T1 Dep visa until (i) expires, and get further extension, and (ii) she qualifies to apply for ILR.

You said she doesnt need to do anything untill her visa expires in 2014 ... ;; However, As i will apply for ILR now and my status will change from Tier 1 to ILR...will that invalid her stay (as she will still be tier 1 dependent)??


As she got her Tier 1 dependent visa last month (December 2012, which is after the new rules of July 2012)


Q1) Her current Tier 1 dependent visa expires in 2014. On her Tier 1 dependent visa expiry date in 2014, she would have only completed 1 year and 3 months - 15 months);;;;

How long her next extension will be when she applies in 2014? and how many extensions will she need to get?

Hi There,

I am currently on ILR (received after 5 years on Tier 1 general+WP)

My wife came here as Tier 1 dependent in Decmber 2012 (needs to complete 5 year to be ellible for settlement) and her CURRENT leave will expire in May 2014 (When she wouLd have only completed 1.5 years)

A quick question:

What Visa she should apply to extend her visa, Tier 1 dependent ext or FLR (m)?

IF TIER 1 Dependent ext, then as the next extension will be 3 years, which will take her to 4.5 at the end of that ext. So she will be 7 months short at that time. I read on teh forums that extensions are closign NEXT YEAR APRIL 2015.

So what will happen to her, when her new extension will expire in 2017? how will she renew in 2017 (when she will be 7 months short of 5 years required stay) as the TIER 1 extensions are closing next year 2015.


PLEASE ADVISE, i cant find answer to this on the forum

PLEASE ITS URGENT.

Agree with wpilr_nov12. Apply for an extension before expiry of leave.

The Tier 1 (General) extensions may be closing but I doubt that they will close the PBS dependants' route. Similarly, the non-PBS work permit route has been closed for years, but their dependants may still apply for extensions and settlement.

can you please confirm which extension should she apply for;

extension as tier 1 dependent or extension on FLR (M) (I am currently on ILR after 5 years on tier1 gerneral+wp)?

You have to apply PBS dependant visa for your wife until she is eligible for her ILR. They would approve visa for 3 years in the extension.

OK, we will apply for her extension through Tier 1 dependent visa form.

Couple of other questions, please advise, thanks in advance.

• Can I accompany her when she goes to PEO office (as she is planning to do it in person) for extension visa application (can I go with her as her communciation is not so good and she wants me to go with her)? Is the partner (husband) allowed to go with dependent inside the PEO office?

Also, she will be paying the fee for the application (£1920) from my bank money, so can I go inside and pay the fee for her application (as i understand you have to use the card at the PEO office to pay the fee)? As she doesn’t have a bank card for herself?
Please advice re this payment option at peo?

Question 1. Yes can join with her

Question 2. You need to pay the fee while booking the appointment itself.

with regards to Question 1, where you said that I can join with her to teh PEO office.

How can I join her? Do i need to put my name when bookign for the appointment for PEO online? or need to tell them separtely that i will be coming with her (as she is the only one applying and i am not applying for my self as i already have ILR)?

The application form you select and the category you choose will sufficient.

When you book the appointment online, it will ask for the below:

Which application form are you using to make your application? -> PBS Dependant Paper Form

Next question will be,

What category of leave has the main applicant applied for? -> Tier 1 (General)

Then, you have to give personal details of the dependant, followed by, searching for appointment and booking it.

I have logged into to book PEO appoitment for her and I have chosen What category of leave has the main applicant applied for? -> Tier 1 (General) and then gave give personal details of the dependant, and serached for appointment to book.

But my question as i asked above is:

Where do we need to mention in the booking process for appotment at PEO that my husband (me) will join my wife and come with her to PEO appoitment? do i need to put my name somehere when booking for the appointment for PEO onlineto tell themthat i will be coming with her?

Not required to mention anywhere. The category itself dependant so you can join with her as you are the main applicant.

Hi josekumar, sorry for a lot of questions:

I know when i booked the aoppointmnet last year for my applciation i had to pay teh whole fee at PEO office.

You mentioned above that my wife (applying for tier 1 dep ext) needs to pay the whole fee while booking the appointment online

Do you mean she needs to pay all £1920 pounds for her tier 1 dependent ext applciation during the booking process online for peo appoitment?
