EEA2 - Surrinder Singh - No right to work?

Hi there

We submitted our application last week and receive a COA on Monday and another letter today saying similar stuff, but at the end it says 'At this stage we are unable to confirm your right to work in the UK. This will depend on the outcome of the application.'

Can someone please tell me why they were 'unable' to confirm the right to work? I have exercised my EU treaty rights in Ireland for over 6 months, we have been married for over a year and we used the UK family permit before the rules changed in Jan.

I was under the impression that him returning to the UK with me means he is legally staying here and automatically gets the right to work. The application (as said on the front) is merely a confirmation of rights.

Will they go through the application and write to us again about the right to work? There are really no major complications in our case. My husband has a 5 year Ireland resident card under the EU law as well.

Please can someone advise on how to go about this as I'm rather annoyed.

I've read on the boards recently of a few cases like this where the spouse was issued the wrong COA. People have been able to contact the Home Office and get the correct COA issued.
