Residence permit - Norway

Post by Cometoireland » Tue Mar 25, 2014 8:41 pm

Greetings. I hope that someone can urgently assist. A friend recently moved to Norway on a family immigration permit. She has been in Norway on this permit since November 2013 though she has been to Norway on many occassions for a period of 3 months each to visit her boyfriend. She had a baby early last year with this guy and her visa was approved because she had the baby. Now, she found out he has been cheating and wants to leave him but they want to co-parent this baby.what is the best way to go about applying for a visa to stay with the baby in norway. She is still unemployed and was in the process of taking the noric classes. Thanks

If her baby is Norwegian then you'll have to check on Norway national law about a baby sponsoring a parent. This seems like a complicated scenario, it might be best to speak to an immigration attorney in Norway.

If her partner and she are on good terms despite the cheating she can continue to stay on the same residence permit until it expires (hopefully there are a few years left ?) and explore her options and have a plan before that happens.

If the residence permit was granted in Nov. 2013, then it should be good for a year; however, I believe you have to notify UDI if your status changes (I cannot confirm this). That being said, liksah is right, if the child was born in Norway, and thus has Norwegian citizenship, then that child can act as a sponsor for the parent. See the UDI website on family immigration for parents of children under 18 at this link for further details.
