Tier1(General) into ILR Visa Process : 90 days query

Dear All,

Can you please suggest me when i can apply for ILR visa ? Because I got a doubt my first gab about 49 days .. please see below the details info.

First Tier1 Visa

Valid from : 01-June-2009
Valid till : 01-June2012
Date of Entered into UK : 27-June-2009

Extended Tier Visa
------------------
Tier1 (General) Leave to Remain
Valid Till : 01-June-2014

my first entry in the UK is 27-June-2009. then after 10 days I went to India to work for the notice period in my previous company (49 days). So after 49 days , i am back to UK .. this absence is also within 90 days after my entry clearance was issued in India. .

But my doubt about this line in the UKBA Site:

"If the absences are connected to other employment outside the UK, which demonstrates the UK employment is secondary,
these are not permitted absences , and the continuous period requirement is broken. "

So can any one please suggest me whether I can go for ILR visa process on May 2014 or do I need to go for another Tier1 General Extension.

I believe you can go for ILR in the same time what you mentioned, But you need to provide a letter from employer that during that period you worked from india. If you not able to provide that letter, Go via solicitor he can manage with out a letter.
