Yes u can.If u fulfill all the requirements.

I had applied my tier 4 application in october 2013 after got refused in tier 1(Ent).And got tier 4 visa within 2 weeks.

mr adilzia how come you got all the visas in on of your posyt you r saying you have got your visa after judical review and in one post you r saying that if anyone applied visa from tier4 to tier1 if they got the visa or not.......mate clear your facts right and do no misguide anyone.

Yes you can apply for Tier 4 application with in 28 days of refusal of Tier 1 application OR you can vary your Tier 1 application into Tier 4 application anytime before HO makes any decision on your Tier 1 application. If you VARY application then the date of application will be the date of your Tier 1 application. (No break at all)

Basic criteria for Tier 4 is:

First calculate 8 years CAP
28 days maintainase funds (as appropriate)
CAS letter
2 photographs
Electronic form
send along withwith covering letter that your original docs (Passport, degree, transcript etc) are laready with HO under the reference number xxxxxxxx (ref number of your Tier 1 app)

I think so u didnt read my all posts.
Read carefully now.

I had tier4 visa till aug 2013.
Applied tier 1 (Ent) December 2012.
Refused tier 1 April 2013.
JR submited against this (tier 1)decision in July 2013.
As well as applied tier 4 application in August 2013.(Approved) Coz my solicitor told me to do that.Coz He said if u lose ur JR.Then ur spent time will not count as illegal.
HO agreed to reconsider my Tier 1 application in Oct 2013.
Tier 1 Visa granted in march 2014.
