ILR Eligibility for my situation

Post by UKtier1subbu » Sun Mar 30, 2014 9:42 pm

Dear members,
Appreciate your expert views to handle my situation.

I landed in UK on 20Jan2010 under Tier 2 (ICT) and then converted to Tier-1 in Aug 2010 and continued in the same employment. I am due for ILR in Feb2015. I have a situation wherein my current employer had send me on work with the same company out of Singapore from Jan13 till 8Dec13. So, I visited UK for that year for only 8 days. But, I was paid salary in UK Bank account for the full 12 months and my employer has also given me a letter stating I was send on deputation.

Will I get qualified for ILR submission in Jan 2015 (Assuming, I will be in UK for more than 180 days in 2014)?

Total in 2012 101 265 0 0 0 0 0 0
Total in 2013 46 8 0 0 0 0 309 2
Total in 2014 2 88 0 0 0 0 0 0

Kindly advice,

Yes, Your absence can be counted as your stay in UK.

You should inlcude the deputation letter and prove your absence as work related.

Absolutely no problem for you, Because you are not away from UK more than 180 days in any of the year. So should be file. But you need to get letter from employer, that should be fine. Ans also you can go for ILR 28 days before your qualifying period, So i believe some time in dec 2014.

Suresh

Sorry i haven't observed, you stayed in singapore more than 180days so its bit tricky.. you can split the 308 days i.e. you need to adjust your start day in such away that 308 days will come 154 in one year and another 154 days in another year. then should be fine i believe.
But take experts advice..
