divorced and marrying again to Non-EU national

Post by SelectMe » Sun Mar 30, 2014 7:31 pm

Hi guys,
I am asking this for friend of mine.
He married to an Irish girl in 2006, then they have Irish kid born who is 7 years old now. then things went wrong and they separated in 2010. Last year they got divorced. He has not got Irish citizenship yet, He applied last year, as He had drink driving conviction about three years ago, the citizenship department had asked him to wait till Jan 15 then minister will make decision on his application. so eventually he will get citizenship.

He has stamp 4 which is valid till Jun 2015. he had informed GNIB about the divorce and they said just renew your permission when it is about to expire. so he is well safe and allow to stay.
And now recently, he married to an other Non-EU girl living outside Ireland. So now he is not sure about some questions like, Could he bring her over and once she is here, would she get Stamp 4 or Stamp 3. i.e. would she be allowed to work without need of Work Permit etc or what kinds entitlements she would have.

Many thanks in advance for your support.

The simple but expensive way is for her to come to Ireland on a non-EU student visa. This will allow her to work part time, but it obviously costs money.

Then she can later apply to change to spouse visa (no guarantee) or if they have a child who is an Irish citizen due to being born in Ireland she can apply for a Zambrano right to remain as the parent of an Irish citizen child.

Hi Brigid,
Thanks for kind reply.
Yes, you r right, this could be another option but it comes with its own pros and cons. So not a great solution.
He was thinking to apply for Stamp 5 stamp as he spent more than 8 years on Stamp 4. but not sure how it ll justify his wife's status.

Regards
