hai guys
i been following this forum since quite a while and its been so help full in providing relevant information

i just got a small query regarding my spouse visa

currently im on tier 1 entrepreneur visa which was granted in jan 2014
i got married last month in uk to an Indian girl u who is holding tier 4 student visa (highly trusted college)
which is suspended 1 wk back...
i wana apply my wife as my dependent inside country..
i have done all the documentation such as

bank statement (90 days)
marriage certificate (uk )
mobile and utility bil on her name
accountant letter showing im running business

i have booked premium appointment which is due on Friday..
im quite nervous what questions are they gona ask me and my wife as her college been suspended
plz replay if any one has gone threw this situation..

u can not switch dependant category inside uk
ur wife has to go back india,and then apply for entry clearance dependant visa

plz dont misguide other forum members ,there is no such rule change on 1st oct 2013.
please read below:

if you are not in the UK as a PBS dependant then you cannot switch and need to apply for entry clearance from outside the UK.

mr killer u will waste ur money to apply inside uk,simple thing is send ur wife back to india,and then apply for tier 1 ent dependant visa.

i am not misguiding anyone just posting what is my understanding with links, i have already posted link in my previous post where u can read court judgement. Person on student visa can switch to PBS dependant of Tier 1 Entrepreneue migrant from inside UK. This is my understanding, pls correct me if i am wrong.

Following changes in the Immigration Rules implemented from 1 October 2013, it is now possible to switch into PBS Dependant of Tier 1 Entrepreneur Migrant from inside the UK unless:
■you were last granted leave to enter or remain as a visitor; or
■you are on temporary admission or temporary release.

From the above, it is clear that anyone who is not in the UK on a visitor visa or an overstayer in the UK can switch into PBS Dependant of Tier 1 Entrepreneur Migrant from inside the UK.

In order to apply for leave to remain as the child of a PBS migrant, the child must be under the age of 18 on the date of application. Where the child is aged 18 or over he/she must have, or have last been granted, leave as the family member of a PBS migrant or someone applying at the same time for leave as a PBS migrant.

basic rule is u cannot switch inside uk unless ur last leave is dependant in any category ,,but in mr killer,s case as he mentioned in his first post that he got married last month and her wife was student visa,,so scenerio is crystal clear,she has to go back and then apply from there ,inside uk switching will not apply on his case.

hai guys thanks for time and valuable suggestions,,

i spoke to ukba it self and they said that i can apply from inside uk under point based system
i booked premium service for Friday morning
what do you recon they gona ask me..???????
as i never been to the premium service before..

hi, there is lot of confusion about dependent's in country application, my friend met with 4 solicitors few days ago and 3 said your dependent cant apply incountry and one said yes you can... ill request seniors to resolve this query please....
