Can I apply for 10 year long residence ILR ?

Post by dreamcatcher » Thu Mar 27, 2014 2:23 pm

I arrived in this country on 10th of September, 2004 with student visa. Thereafter I had extended my visa for few times. Immigration history are written below:

10/09/2004 - Entered UK with student visa valid until 31/02/2006.
24/01/2006 - Student visa extension application submitted. Given Leave to Remain until 30/11/2006.
20/11/2006 - Student visa extension application submitted. Given Leave to Remain until 30/11/2008.
28/11/2008 - Student visa extension application submitted. Given Leave to Remain until 13/07/2009.
22/03/2009 - Tier 1 PSW application submitted. Given Leave to remain until 30/04/2011.
12/01/2010 - Tier 1 General application submitted. Given Leave to remain until 07/06/2013.
26/06/2013 - Tier 2 general PEO application submitted and granted on same day with leave to remain until 09/07/2016.

Now my employment is coming to an end on 30/04/2014 due to redundancy. The earliest I can apply for SET(LR) is 28 days before 10/09/2014 which is 12/08/2014. I have my wife as a pbs dependent in this country since May 2009 and I have a 3 year old son born in the UK. We are expecting a baby in July 2014.
My questions are as follows.
1. Once my employer informs UKBA of the end of my employment, how long does the UKBA take to decide on the curtailment of tier 2 general leave to remain?
2. If my leave is curtailed to 60 days, and I have reached upto 12/08/2014 then can I apply for long residence ILR within that 60 day period?
3. Should I apply FLR(M) for my wife at the same time?

I would greatly appreciate your help and expert opinion.

Can anyone please provide feedback?

Would I be OK for 10 year ILR application or I need to make an application first and then apply for variation of leave to SET(LR)?

Please help!

Hi
I think it depends on when your visa is curtailed which depends on how quick your employ notify the HO and how quick they decide to act. You have no control over that except to hope there is delay either from your employer or HO. If your leave is valid upto 12/08/14 then you can apply for ILR from that date.
You are allowed to overstay for up to 28days just in case your visa is curtailed before the earliest that you can apply. Although I will not advise anyone to wilfully overstay.
The other option might be to make application on some other routes and then apply to vary although that depends on if your application is yet to be decided.
As per your wife the rules are changing on 6th April which means time spent as a PBS migrant cannot be added to time on flr M. Your best is to make application for FLR M and ask them to hold it until you have been given ILR.

Hi
I think you can wait and see how things go and decide with the time probably Further leave to remain for the expected baby birth might be a better options and on completion of 10 yrs Vary your application.
