Hi all,

I'd like to thank everyone who posted on here. I've just received my BRP today. It's a straightforward case - 6 years student, 2 years PSW + the rest Tier 1 General.

All the updates, approvals (and refusal) has helped making the wait a lot more tolerable. So thank you. Here's my timeline.

Application sent: 17/12/2013
Acknowledgement letter received: not sure, I went through a solicitor.
Bio received : 15/01/2014
Bio done: 20/01/2014
Ilr ganted: 01/04/2014
Document received: 02/04/2014
Brp received: 04/04/2014

Best of luck to those who are still waiting.

Please don't get confused, as you did the right thing. Just to reassure you I did the same thing just two day ago on my wife FLR(M) application. So not to worry. You been through a lot with your application now your wife's application, now is time to relax for a while and hope for the best. Take care buddy and all the best.

I just posted my wife's application FLR M. My application SET LR is in process. Lets see what happen. Hope for the best.

Unfortunately who received refusals please dont give up. Try to figure out through courts.

your children will need to apply for further leave to remain using form FLR(M) and i believe from my understanding of your statement above that they would be affected by the new rule if they are currently on your previous visa before your 10yrs grant of ILR otherwise if they already depend on you based on form FLR(M), then they won't be affected. But the moderators will throw more light on your issue/query.

I will need more clarifications for i think the FLR(M) and SET(M) are for partners of a settled person not children were both parents are settled. My wife has applied on her own merit under the 10 year long stay and if her application is approved then we are both settled persons.

Just to quote UKBA:

"You can use form SET(M) to apply to settle here as the husband, wife, civil partner or unmarried/same-sex partner of a British citizen or someone who is settled here."

Can the Gurus help please ...Amber, Vinny and co.

Thanks Shah. Let's now see what actually happens on 6th April. My biggest fear is that they might say that applications which were asked to be put on hold will come under new rule. Just playing devil's advocate here!

Did you submit English test certificate or you are in the same boat as me?

Hi Everyone:

I have sent my ILR application via solicitor. I have been reading this forum(very informative) and alot of people have mentioned that along with originals, send photocopies of a all documents aswell. I checked with my solicitor but he has only sent the originals and said photocopies are only required with premium service applications(which doesnt apply to SET LR). Bit confused and worried now, please help.

Don't worry my friend forgot to send photocopies and he got his ILR without any hassle.

Just wondering why would you use a solicitor? Do you have any complications in ur case? otherwise its a very simple application form and only documents required are your all passports (covering past 10 years), LIUK test and an english test/degree certificate.

yes she can apply any time from now on wards .as she got 2 years visa it means she is under old rules .don't worry apply any time but do remember u need liuk and english level B1.today my friend went to peo to get ilr on setm ( got flr on 2 april 2014 )still didnt receive brp .in peo they said their documents are all fine but they need brp to issue ilr so they rearrange appointment for her for next week and said she will be eligible for ilr and there is nothing to do with new rules.good luck

Hey Guys....I am going to apply my MRs Flr(m) tomorrow morning. I couldnt do it today as bank delayed my statement. Any way i will post it tomorrow before 12 Mid day.....I hope I still be on time......

Yes she has done her life in the uk and got city and guilds skills for life entry level 3 which is equivalent to B1 and she has already used this certificate for her flr m. My real concern is u know my last visa was TIER 4 student visa which has been extended April 2012.do u think tier 4 pbs dependents are eligible for set m? If yes is it ok to apply after 6 th of April and why my solicitors said she can't apply for ilr because this rules apply only for tier1 and tier2. Pls don't mind I m really in dark.

this is the mail from ho regarding pre july applicants and it says you can combine pbs leave with flr to get ilr.put wait for some one else to clarify more.
Dear Sir/Madam,



Thank you for your email, I apologise for the delay in responding.



1. If a person has been granted ILR on the basis of 10 years long residence, their spouse can no longer be considered as a PBS dependant, and they must apply for an extension of stay as the partner of a settled person on application form FLR(M). A person here as a PBS dependant would not be able to meet the settlement requirements of the spouse rules if they were to apply directly, without first applying for limited leave to remain on form FLR(M).



2. As long as the spouse was granted leave to enter or remain as the dependant of a PBS migrant prior to 9 July 2012, then the spouse can be considered under the transitional Part 8 rules for further leave to remain as the spouse of a settled person under Paragraph 284. These Part 8 rules do not include the Financial Requirements (including earnings over £18,600) you have mentioned, however they do require an applicant to be adequately maintained and accommodated without recourse to public funds. 3. A spouse can combine any leave as a PBS dependant with leave as the partner of a settled person granted under Part 8, to meet the qualifying period under paragraph 287 of the Immigration Rules, which is 2 years. SET(M) or FLR(M) PEO experience

I am sorry for late responding!

PEO Liverpool

i recieved my ILR (long residency) on 01-04-2014 (on april fool day) and booked SET(M) appointment for my wife straightway in liverpool at 09:00. I filled both forms (SETM & FLRM) and documents for both were almost same apart from LIUK test.

I arrived at 07:30, entered in UKVI office at 08:00
been told by security to wait till 08:30
i found a case worker free and had chat with him for around 20 min he was also waiting for 08:30
at 08:30, called on counter and sign a form (related with visa policies and outcome awareness)
lady said, do you know about policies we said yes
i explain some points she said let me confirm from inside
she came back after and said sorry u have to apply FLRM 1st
Mean time the case worker who i had chat with earlier, ask lady to send this file on my desk
he explained us, although we gave few ILR (about 5) like just you said
but it was our fault, if you get ILR like this if any immigration officer question you on airport or anywhere that how u get ur ILR then it will be hard for u to prove that u had ur ILR thru right way
then my wife said ok we not gonna go for SETM straghtway can u consider our FLRM 1st and then SETM
he said yes but can't take ur biometrice twice in one day u need to come another day with appmmnt for SETM
then my wife said leave it on FLRM, we will apply SETM next week
he said give me some time, give ur biometrics
at 08:55 they gave us all documents and said now you can apply for SETM from tmrw
Aproval letter is standard FLRM (according to 5 years rout)
but he mentioned thru his handwritng that u visa will b for 2 years according to part8
now booking SETM app for next week all documents ready ..need to filled new form
they said ur fees difference will b deposited in card in next few days

Hi Malik,
I send the English language test result along, but not to worry as any ways the application will be on hold for some times which gives you time to send any further documents.
Regards to goal shifts and Home office, nothing will surprise me, but I hope they never come round to do that change :lol:

My wife joined me in 2005 . I will apply on long residence base in August . I am on tier 1 general. She is my dependent. I asked this before as well . Honestly don't understand what's going on.

I have no complications in my case, its a straight forward 8 years student + 2 years PSW. I sent it via solicitor, just for peace of mind. But I know what you mean, after reading this forum i have realized that I could just sent it on my own. But its done now, so just hoping & praying that I get it soon.
