FLR(m) or PBS Dependant

Post by Section6.3 » Sun Mar 23, 2014 5:30 pm

Hi, I've had a look at the forum for a similar situation but haven't been able to find answers so I was wondering if you can help:
I was recently granted ILR (Feb 2014) as I was on a Tier 1 visa for 5 years. My wife joined me in June 2012 but as she hasn't finished 2 years of living with me, cannot apply for ILR.

With these new rules floating around, is it better she applies for FLR(M) or PBS dependant before 6th April? Also will she qualify for ILR in June 2014?

Any help would be much appreciated.

Many thanks!

When does her current leave expire?

Thanks for your response. Her current leave is due to expire on the 11th of May, so before she completes 2 years in the UK with me. Ideally I would like her to apply for ILR in June (which is two years). She was all ready to apply using FLR(m). I was reading somewhere that if she applies through flr(m) her 2 years would be reset (under new rules from 6th April) which might not be the case with renewing again as a PBS dependent.

Her appointment is on Tuesday (25th) so any advice would be much appreciated! We are really confused with these new rules.

When in June 2012 did she enter the UK?

You should be ok, A1 English required. Ensure the leave is granted under part 8 of the immigration rules for 2 years.
