Should the employer also need mention that I was out of the UK during my paid annual leaves?

Hi Vish,

The letter is in reference to only those absences when you left the United Kingdom.

Set O page 15 Section 6.2

Since then have you had any absences from the UK? If yes, give the dates you left
and returned to the UK
and the reason for the absence....

Hi,

I am a bit confuse on few question in the form. I would really appreciate if you can reply to them.

I have been in UK since 9 year. came as student - PSW - Tier 1(general)

What should answer for
Q6.1 - Date for when the visa was issue in UK
Q7.11 9years or 4.11years
Section 10
Q2.3
Q2.4
Q2.5
Q8
Q9

Section 11
Q11L - Since my last 5 years are made of only Tier 1 (general) - Do i still need to tick this option.

Hi sidss,

Welcome the forum!

As your Set (O) ILR application is based on your Tier 1 (G), any questions on the form are pertinent only to the Tier 1 (G) visa.

Therefore, Q 7.11 would be 4years 11months

Did you fill up the table under 7.11 for the absences in and out ,
"Please provide details of any periods of absence of more than 6 months during that time"
do we need to fill only if absences are more than 6 months or any absences ?

As the form asks for "any periods of absence of more than 6 months during that time." - leave it blank if there are none.

As the calculation of the continuous period in the UK (page 19) is based on 6 months, this is in reference to each year.

"No more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the application for indefinite leave to remain (ILR)."

Hi Mind the Gap,

Congrats on your ILR.

I'm going on 14th April and so far have all the docs ready except the absence letter from employer.

I was out if UK only for 2 weeks and was on my holidays, but don't see the reason to provide the letter from employer. However from your experience it seems like its necessary.

So a quick question does the letter have to be current or back dated and if you don't mind can you pleae share the format?

Also to prove absence from UK a paid salary slip and corresponding amount in bank statement for that absent month can be used as an evidence.

Or a print out signed from the holiday booking system signed by hr.

It would certainly look better if the absence letter was current, however there is no hard and fast rule here.

Here's the template I used:

Application for Indefinite Leave to Remain in the UK under Tier 1 (G)

This is to confirm that XXXXXX has been employed in the United Kingdom by XXXXX since XXXXX.

He was absent from the United Kingdom on annual leave during the following period:

Hi..

Congrats....I am going to Croydon this Saturday. Please let me know whether they specifically asked for 12 months bank statement. I only got last 6 months original statements and 12 month pay slip. I read from other posting only last 3 months required.

You need to submit 12 month bank statements unless you cover your earnings in 6 months

Argus is correct - Under the Tier 1 point scoring assessment, "You can claim points for previous earnings for any single, consecutive 12 month period from the 15 months immediately before this application"Page 25, Set O Form

Supporting evidence - "You should be aware that at least two types of documentation for each source of earnings must be provided (Self-employed applicants must also provide an additional document as listed in Annex A of
Chapter 6A Tier 1 Settlement of the Immigration Directorate Instructions). If earnings from any one
source have been paid in more than one way (for example payment for a period of employment by
means of a monthly salary and a dividend), two types of documentation must be provided in respect of
each part of the payment claimed. The supporting evidence must be from separate sources and must
corroborate with one another to clearly support the earnings claimed. Accountants providing evidence
must be appropriately regulated, and evidence of the regulation must be provided." Page 28, Set O Form


For example, you earned £35,000 from April 2013 to March 2014. If employed, you submit 12 payslips for each month + a bank statment/s confirming this.

I am applying as Tier 2 migrant ( under 5 year route). I am bit worried whether at Croydon they are asking for 12 months bank statements from everyone irrespective of category. I see everyone submitting 12 months statement and this has become like a standard. I wonder whether case workers are also expecting from everyone 12 months statements. In your case you did not meet the caseworker. I am wondering whether people at the counter instruct you to keep bank statements or specifically say 12 months statements irrespective of category.

Well simple go by the rules. They ask for 2 sources of evidences 12 months payslips and 12 month banks statements go with that.
Gte the bank to provide stamps and signature of the statement print outs if possible. And this was always the case.

Hi sak20099,

I have applied for ILR at Croydon today and it went successful.

Documents provided and needed

1) Set (O) form for self and dependants
2) Appointment letter print out along with Fee paid proof
3) 12 months Payslips and Bank Statements showing the same and highlighted
4) KOL and Life in UK Test for both myself and spouse (I didn't have KOL certificate as had Masters Degree from UK University)
5) 3 months saving statement showing Maintenance Funds for myself and 3 dependants
6) Absence letter from employer supported by same period payslip and Bank statement i.e. Feb 11, absence was only 2 weeks
7) Driving License Counterpart as had 3 Fixed Penalty Points (Although it's mentioned in the form that Fixed Penalty Points are exempted but it's better to declare it yourself)
Cohabitation documents i.e. 2 years utility bills and mortgage statement
9) PBS calculator print out

Photocopies of all documents is a must along with the copies of your recent and previous passports and Biometric Cards.

Appointment time was 1300 hrs and was returned at 1500 hrs no interview, waited in the cafeteria, parking is also very convenient just opposite in the Whitgift Centre.

Very good, efficient staff and system.
