Am I eligible for ILR

Dear Friends,
I am trying for settlement/ILR visa. Here are my case details.

1. Came to UK on Work Permit (WP) on 05-Apr-2008 and returned to India on 05-Oct-2009.
WP - Valid from 10/Jan/2008 and Valid until 10/Jan/2010. Worked company was TCS
2. BREAK: I was in India for consecutive11 months i.e from 06-Oct-2009 till 10-Sep-2010
3. Came to UK on Tier 2 (ICT) Estabished Staff on 11-Sep-2010.
ICT - Valid from 13/Jul/2010 and Valid until 26/Jul/2012. Sponser: Same company as above (TCS)
4. Coverted with in UK from Tier 2 (ICT) to Tier 2 General on 19-May-2011. Sponser was : DF
4. Changed the sponser with in UK - Tier 2 General on 29-Jun-2012. Visa valid until 13-Jul-2015. Sponser is: CGS

I am currently on Tier 2 (General) working for CGS and visa valid until 13-Jul-2015.
Considering the case details as above and more importantly the break I had for consecutive 11 months ( out of which I was in India without Visa for about 184 days), is there a possibility of getting ILR?

Please help me.

My solicitor is recommending me to take a risk. Is it worth taking the risk? Will the UKBA, consider my application out of rules due to that fact I first entered in UK in 2008?

what do you think? Did you see the continuous period of calculation of leave?

Did you exceed 180 days in every yr then you are not eligible
