Please Need Advice With This Uncommon Case

Hi Everyone

I have an Egyptian friend who came here in a spouse visa. Him and his wife lives apart now. For some reason he didn't get ILR. He got 3 years visa. Now he is living in UK for 5 years and still under this 3 years visa. He has got new girl friend and he has got 3 kids from her.

Does he has the right to apply for ILR since he stayed for 5 years?

Someone told him he can apply as a father to a british children?

Could you please advise what he can apply to?

Can't apply for ILR but may be able to apply for FLR(M) or FLR(FP) depending on the circumstances.
