It is contradictory to what How long you can stay section say in https://www.gov.uk/tier-1-general

A rule of thumb is take email/telephonic response of Home Office with grain of salt

We called the UKBA about the length of extension thing last year, when there were first rumours about extensions closing in 2014, and they said they normally alternate. So if you got an initial grant of 2 years, then you get 3, then you get 2 etc. This is consistent with what our solicitor has told us. BUT there are members that seem to have successfully challenged it when the UKBA has only given them 2 years, so I'm not sure what the reality is.

That it is not clear is utterly ridiculous. :x

Is this rule applicable for Tie1 General dependents also ?

i.e. some one who is on Tier1 General gets married after 6th April 2015, will he be able to apply for dependent visa for his wife ?
Or is a dependent needs extension after April 2015, is that allowed ?

this is not related to dependants, they can have extsnions

•Tier 1 General visas now only have until 6th April 2018 to apply for ILR and if you apply the rule change above, this means that only those Tier 1 General holders that were granted an initial 3 year visa and apply for another visa extension just before 6th April 2015 can make it all the way to April 2018. If you were granted an initial 2 year visa when you first got a Tier 1 General visa, you will only be able to get yourself to April 2017 if you apply for another extension just before 6th April 2015.


•I am sorry to say that should you not be able to secure Indefinite Leave to Remain by April 2018, your only options would be to either return to your home country or switch onto another visa category. The trouble is, the only other visa category you could realistically switch into would be the Tier 2 General visa and your earnings from the employer would need to be higher than £35,000 per annum to qualify for ILR from 2015. Whilst you can put a Tier 1 General visa and a Tier 2 General visa together to make the 5 years for ILR, you could not be self-employed; you cannot operate through your own limited company and need an employer with a Sponsorship License to sponsor your application. You could always try and switch onto a Tier 1 Entrepreneur visa with a £200,000 investment but the 5 years for ILR would start all over again (as you cannot combine the time on the Tier 1 General visa with this category).


•There are many clients that have not been able to apply for ILR after 5 years on a Tier 1 General visa FYI due to the following main reasons: 1) Breaking the maximum 180 day a year time outside requirement 2) Receiving a police warning, caution, criminal record or other fine in court such as a County Court Judgement (CCJ) or traffic offences.

Are you sure that those initially granted T1 G before 6 April 2010 can be granted a 3 year on second extension? i.e. 3+2+3?
And those after 6 April 2010 will get 2 year on second extension? i.e. 2+3+2?

Hi All,

With new rule evey now & then, need to understand if I am eligible for ILR.

My Visa start date - 20 FEB 2011

My first entry in UK - 27 April 2011

Been on /off from UK - 10 Day per calendar (Not much)

Visa Valid till - 20 Feb 2016.

Query -

1. Am I eligible for ILR prior to Feb 2016

2. and by when can I do it (how many days before my visa expires)

3. Is it a good idea to get a 2nd extension before April 2015 to be on safe side.

4. I got 2 + 3 year visa ; if I apply 2nd extension how long will it be.

Hi Guys,

I just came to know of the tier 1 extension and ILR limits today. I have gone through the thread and among different questions, one I saw frequently is the question I have too i.e. :

Can we apply for extension before April 2015 , if that means applying even a year before current visa expiry ?

I have seen number of replies confirming that this is fine, i.e. applying 6 months, 10 months or even a year before the actual expiry date. What I have not seen ( or might have missed ) is any official link of policy/rules confirming that this is case .

Is any one able to please point me to related official link for policy/rules confirming this ?

Hi All

Since there's been many news moving around in this forum about extension deadlines. So thought of posting here to the gurus to know if I need to worry about any 2nd extension. Does 2nd Ext means ILR or just an extension for ppl short of 5 years.

I got my Tier 1 on 29 September 2011, till 29 September 2013

Got my first extension on 11 september 2013 till 11 September 2016

From the above dates, I am short of roughly 20 days which is fine as we can apply under 28 days. So thats all good.

Do I need to worry about any extension or I straight away qualify for ILR in 2016? Is that the whole thing about dates going to affect me?

Any feedback will be much appreciated

You can only apply to ILR after 1st Sep 2016 and before your visa expires if that makes sense.

Hi,
Can anyone comment on this rule will affect extensions for dependants?

I have an ILR and my wife is on Tier 1 dependant visa. She will not qualify for ILR before April 2015.

Does the fact there they are stopping Tier 1 extensions in April 2015 affect extensions for dependants as well?

Dependants can extend even after april2015 .

Tier 1 (G) is closed but the dependents are still allowed to apply and come over to the UK - that should give you a hint :)

Hello,

My husband is tier 1 general main applicant, his visa is valid till Feb, 2016. We are planning to extend his visa before April 2015 because of new rule. I am tier 1 general dependant staying in UK, I have dependant visa valid till Feb 2016.

Is it possible that I will continue my stay in UK and will renew my visa i.e. Tier 1 General Dependant Visa after April 2015.

Please give me answer asap.

After first extension on Feb 2013 , my current visa expires on 24-Feb 2016

In between , I was out of UK last year for 2 months (2 Sep 2013- 2 Nov 2013)
I have again plan to go out of UK for one month this year 2014 and possibly next year 2015 and also in 2016

Here are my queries:


1. Is the criteria of maximum number of days,(180 days) that is permitted outside of UK , i.e 180 days, is continous period of 180 days in a year or over a period of 5 year

2. Am I eligible to apply for ILR in Feb 2016 or I need to have another extension in April 2015, in order to satisfy the criteria of 5 years in UK ?

3. My second extension will be for 2 years or 3 years ?

4. If I apply for second extension on Mar 2015 (my current visa expires on 24-Feb 2016), will my extension (2 or 3 years) start from
original previous expiry date ie 24-Feb 2016 or from the date of application e.g Mar 2015

Hey Guys,

I have just found about this.

Can someone please help me understand my situation.

Initial Tier1: October 2010 (2 Years)
Entered UK: March 2011
Extension: October 202 (3 Years)
Visa expires: October 2015

Am I correct to assume that I can/have to apply for extension before end of April, 2015?

Your 5year period starts only after 15Aug 2011. So you can apply to ILR only 28 days before Aug2016. 180days is for one year but u will have only 90days to get into the country.

if you apply for visa in April 2015, irrespective of 2yrs or 3yrs period any ull be eligible for ILR 28days before Aug2016

Your 5year period starts only after 15Aug 2011. So you can apply to ILR only 28 days before Aug2016. 180days is for one year but u will have only 90days to get into the country.

hi might power, I am also in your ship but the problem is that for second renewal you will have to show again 65000 that s the problem plz share your experience. what we suppose to do .. my next renewal was on nov 2015 .. I got visa in oct 2010 I came in this country july 2011... I am worried please help what I supposed to do,

I feel that they gonna start refusal because we all have valid visa and they wont give us the decision of appeal .. I reckon.
