visitation of child as reason to reside in uk

Post by missconfused » Tue Jul 24, 2007 12:00 pm

What are peoples exeriences with an overstayer trying to seek visitation rights so they can use that as a reason to stay in the Uk. Please note that this person was already an overstayer when the case started and currently does not have rights for contact but is in the process of trying to get contact. Is there any way that this person will have to go back to their conuntry?

Help is needed on this one as quickly as possible please anybody with experience on this?
Moderators any help would also be very much appreciated.

I think first things first
If the person has no basis to see the child
Then it would be better to wait to see if you get it.
Otherwise, a search of the bia site will provide you the framework of rules for such an occurence should it occur.
To start coming up with hypotheticals and how to approch the situation is idle speculaition

A few questions;
1. The child's, mother's and father's (you?) nationality?
2. How old is the child?
3. Did the father ever support the child in any way before? Did/does the father have no (legal/official) right of access to the child? How/why was it lost?
4. Father's previous immigration history?
