I have also won appeal to extinct and same decission was for my partners appeal as both appeals were linked together by judge.
What really confusion here is that how come HO can consider one applicant as Genuine entrepreneur and the other memeber as fake entrepreneur. Both members of team application are directors of same business have got same qualifications, funds 50k in joint account, maintenance fund, CAR, accounts, advertisements everything is same then how possibly HO can refuse one applicant that he isn't a genuine applicant and issue visa to other applicant that yes you are genuine.
This is absolutely not understandable to me, and would request serious members to kindly describe this sort of situation that how possibly common business documents b/w two members of entrepreneurial team are fine for one member and are wrong for second member? Is there any thing in guidelines or immigration rules regarding this or it's just because Case worker like the things his way?
Note: we both members had applied initial application in October 2013 even before introduction of Genuine entrepreneur test, even though HO has declared that GET applies on outstanding application as well. Still if Genuine entrepreneur test been applied on both applicants then how come one is eligible for visa on same documents and the second member isn't.
I request senior members to kindly push this issue up to discussion and enlight the applicant like us.
