What I should do about HSMP

What I should do about HSMP

Hi,

I came to UK on 02/2007 and working in UK since 02/2007 on work permit. Have work permit for 5 yrs.

Salary is 15,000 pound p.a. in UK

Qualification: M.E. ( Master ) from India

In India, I worked in a company and salary was 5000 pound p.a. but i worked 10 months only. There is no tax return as moved to UK before April.
I closed my bank before i came to UK and I have no bank statements.

Only i have pay slips and offer letter from indian company.

My details

Points
Age: 10
Earning: 25 ( doubt)
Qualification: 35
UK experience: 5

Total: 75 (doubt)

I am not happy with salary in UK, i want to apply for hsmp?

Should i apply for hsmp on my pay slip and offer letter?

Please advise me what i should do?

If you were to claim your UK income pro rata, how do you figure that you could get 25 points for previous earnings ? The minimum earnings level in Band A countries is £16000 just to get 5 points. AG

You have to wait for an year before you apply for HSMP.

If you are on workpermit, why is your employer paying you £15,000 as a workpermit holder you should atleast start with 24k.

Vinod, I understand what you are trying to do - ie get your HSMP based on the GBP4000 ten month salary in India, and then have that pro rated to GBP4,800 p.a. in Band D, as you lived in india for a majority of the last 15 months. The logic behind that is sound.

But your proof is not. Please read the guidance notes, which clearly states what you need to supply to support your claims.

1. The indicated Indian per annum salary (ie already annualised) was £4000, so it would not logically be adjusted to £4800 as an annual equivalent. £4000 gets 15 points; £4800 gets 20 points.
2. Can one claim five points UK experience if one does not claim points for prior earnings in the UK (since one would otherwise prorate Indian earnings) ?
3. That offer letter won't serve the purpose - the caseworker will want to see corroboration of what was actually earned in the period in question (prorated to the 12-month equivalent if necessary), so that letter needs to be retrospective, not prospective.
4. One might look into getting bank statements reissued and/or obtaining the tax return.

Obtaining the tax return is not that difficult in India. Specially since this time its an attachment-less process. Which means you don't need to send any attachments with your ITR. Just download and fill the form from IT website.

Find a CA in India who can file the return for you. Btw last date for filing return is 31st July, so you better move fast.
