ok and its too early before you can do anything so just wait for 8 to 10 weeks and if u dont hear anything then start chasing up and get in touch with me and going to MP might be a good option too.

Since then calling HO and chasing up every single day and finally received my passport and approval letter............. I am Mohammad Ali, applied on 5th March 2014, and got a refusal yesterday, I will explain my situation below

As I was applying provision under (d), i am required to to demonstrate 4 additional criteria which includes,
1. are applying for leave to remain
2. have , or were lasted granted. leave as a tier 1 (Post Study Work) Migrant
3. were on a date falling within three months immediately prior to the date of application(a).registered with HM Revenue and Customs as self employed, or (b). registered as a new business in which he is a director, (c). registered as a director of an existing business or (d)core service his business provides to its customers or clients involves the business delivering a service in an occupation at NQF level 4 or above.
then they said I have demonstrated that I satisfy 1,2, and 3 , but for requirement 4, they are not satisfied that I am working in an occupation skilled at NQF level 4
NOTE: My registered business is a holiday package service company which helps clients or customers to find a designed holiday packages on their own taste, I have given BUSINESS DEVELOPMENT MANGER designation as it comes above NQF level 4 or above with an SOC soc code

But, in refusal letter they say, stated job title of Business development manager does not reflect the services that your business is offering as the evidence that you have supplied for business activity shows that the core service of your business is providing travel agency services.
As such I have failed to demonstrate the core service of my business does not match NQF level 4

I dont know how to appeal against this, will it be worth ? can you kindly suggest

I am sorry as I made a mistake assuming that you are an accountant.
However, if you can help me or suggest someone who can help me it would be great. I need to file my company returns and the deadline is tomorrow, if I miss this deadline than I have to pay penalty of 150£. With regards to my company, it is private ltd company and there is no business activity so far. So basically you can say it was inactive for the last 1 year. Can you tell me how can I submit my company return or who can help me.

If its annual return then its vry easy and atraight forward i think u can regiater urself for online submission and if i m not wrong than its called webfiling and evrything is very self explanatory and if ur company is not trading than u submit the return as dormant but u need to be carefull as it might be a problem at the time of extension.

Sorry to har abt ur refusal irrespective of job title nature of business suppose to be level 4 above too but travel agency is not a level 4 business as per my understanding and knowledge ..... Plz check soc code file for more accurate information.

I guess u will be better off reapplying with business and job activity both level 4 above.

My visa got refused on the basis of following reasons

1. Your business plan was copied from website they have not mentioned which website and it uses another company name in the following sentence. "Business success realises that one strategy for one business and other could be good for other businesses". ( here they think business success is a company name. My point is I would have taken this from website It could have been copied I was not submitting a thesis so i didn't put any references I liked the idea and I used it in my plan )
2. You have told us how did you conduct your market research during an interview but no evidence was submitted. (I did not submit market research but explained him in detail how i conducted my market research how can they refuse on this reason when it was not compulsory to submit market research)
3. Your experience doesn't relate to the business you are doing (He asked this question during an interview I submitted my CV , I have done MBA from UK and explained him during an interview that it does match as my business is business consultancy and I have worked in sales and role where my job title was senior merchandiser but one of my main job duties was of business development don't know how to satisfy HO on this ) ?
4. You have mentioned on your website that you will be giving services in different fields like HR, Finance etc which is mis leading for customers as you are not covering all the fields as of now ( I explained him in an interview that my plan is to hire 2 people in specialised fields who can cover other areas for me)

Also I am thinking to withdraw my appeal and put a fresh new work permit application which is totally a different category but not sure if I will get a right of appeal incase my work permit gets refused just to be on a safe side. I know for the fact that I will definitely not get any right of appeal if i put a fresh entrepreneur application.

ANSWER: As mentioned above, I think only you can answer this where you copied or took ideas and why its there in your business plan.

ANSWER: yes it was not compulsory but bearing in mind one thing lead to another and that is what happened in your case, concerned raised on business plan automatically bring doubts in other parts of business plan tooo ..... business plan copied and market research not submitted. (even though you have explained details in interview but I think this can be easily defended and argue in appeal)


3. Your experience doesn't relate to the business you are doing (He asked this question during an interview I submitted my CV , I have done MBA from UK and explained him during an interview that it does match as my business is business consultancy and I have worked in sales and role where my job title was senior merchandiser but one of my main job duties was of business development don't know how to satisfy HO on this ) ?

ANSWER: again this can be easily defended in appeal if you have relevant experience in the field as mention above. try to get an experience letter from your employer as it will be very handy in appeal.

ANSWER: bit tricky but can be dealt with that your are advertising these services and once approached by client and after agreeing price etc we can provide all the services which are advertised by our business.

ANSWER: I think you have fair bit of chance of winning the appeal as long as you can give solid answers to the raised refusal points ..... regarding applying different category, in case of refusal you will not get right of appeal so think before you decided to go on that track ...... (even you can do that if you appeal is refused)

I have applied Tier1 Entrepreneur visa on 24th June 2013 with team.
rejected my application on 18th July 2013. another member got approved on 17th July 2013.
I appealed to FTT via paper appeal.
appeal approved and determination in 6th Jan 2014. (my business partner withdrawn with me on 22nd Jan 2014 and started own business)
till today no refund and no answer from Home office.

I have called three times they are keep saying it is in queue. Can you pls advice me to make fast my application.
