CITIZENSHIP

Post by kbk » Tue Apr 29, 2014 12:31 pm

Hi

I have been living in the UK from last four years and got ILR last year as my husband was on tier 1 and we applied together for ILR. But unfortunately we are getting divorced now. Can I apply for the British Citizenship this year after I complete 1 year of ILR?

How long have you been resident in the UK?

Then so far as you apply after May 2015 and meet the other standard requirements there shouldn't be an issue. You may be able to apply before this if, your husband becomes British and you do not have a decree absolute.

I have got decree nisi this month so I will get decree absolute before I complete my 1 year with ILR. Could you please let me know about the supporting documents if I apply in May 2015?

Hi

I haven't got decree absolute yet but we got separated now.Could you please suggest me that should I apply for citizenship now or later as my husband is on ILR. Could you check the supporting documents list below:
1.My Passport
2. ILR Card
3.Life in UK test certificate
4. Marriage Certificate
5. Letter from emplyer

what else do I need?

If your husband, even if separated, is not British yet, you cannot apply until you have been resident for 5 years in the UK.

The divorce will not affect your ILR, so as Amber has advised previously, if you meet all the requirements in May 2015, you can apply on the basis of 5 years residence.

If you apply now, you will likely be refused as you do not meet the requirements of 5 years residence or as spouse of British Citizen.
