Hi

My current LTR is valid till 23 May 2014.

My Tier 1 General Visa first started on 23 May 2009 till 23 May 2012 and my first entry in UK was on 28/06/2009.
Since then I got one extension from 23 May 2012 to 23 May 2014.

My Absences are:
From To
23 May 2009 - 28 Jun 2009(until first UK entry) [35 days]
11 Jul 2009 - 29 Jul 2009 [17 days]
23 Aug 2009 - 11 Oct 2009 [48 days]
31 Mar 2012 - 13 Apr 2012 [12 days]
24 Dec 2012 - 03 Jan 2013 [9 days]
17 Jan 2014 - 20 Jan 2014 [2 days]

consecutive periods
Year 1 05-May-14 06-May-13 [2 days]
Year 2 05-May-13 06-May-12 [9 days]
Year 3 05-May-12 06-May-11 [12 days]
Year 4 05-May-11 06-May-10 [0 days]
Year 5 05-May-10 06-May-09 [119 days]

Please see if my calculations are correct and If I am eligible for ILR or should I go for 2nd extension.

U don't need second extension.. U can go for ILR..only question I have ..why are you counting your start day from 6 th May.. I believe from 23rd May onwards as u got tier 1 from 23 May

I thought continuous period is counted backwards from date of application, which I have tentatively put 6th May. Please correct my understanding.

Consecutive periods. Applying on 3 May 2014

Year 1 03-May-14 24-May-13 [absence 2 days]
Year 2 22-May-13 23-May-12 [9 days]
Year 3 22-May-12 23-May-11 [12 days]
Year 4 22-May-11 23-May-10 [0 days]
Year 5 22-May-10 23-May-09 [100 days] 35 (before first entry) + 17 + 48
Total: 123 days

If I apply on 3 May 2014
1. I have covered a period from 28 Jun 2009 to 3 May 2014 = 4 years, 10 months, 5 days excluding the end date
2. If I use visa start date from 28 Jun 2009 to 3 May 2014, I have covered 4 years, 11 months, 10 days excluding the end date

Please advise which is applicable and and am I eligible if my continuous period is 4 years, 10 months, which is less than 5 years.

Yash- you count your start from 23 may 2009 as you entered uk within the 90 days from the day you were granted tier 1 visa and your start date start from the date you got the visa.. And you can apply 28 days before you complete 5 yrs .. Hope I have answered all your queries.. You can find many such examples in this forum..
