Financial req (E-ECP 3.1(b)) for entry clearance as partner

Hi,

I need some advise on the below situation:

I am currently on ILR (issued in Feb' 2013).. I am getting married in India in May and then I need to apply a visa for my partner so that she can come to UK and settle with me. While going through all the rules, I am really confused about the rule E-ECP 3.1(b) specified in the Appendix FM (https://www.gov.uk/government/publicati ... ppendix-fm)

My current monthly gross salary is: £4580
Take home after tax: £3150 / month
House rent: £750 / month
Council tax: £120 / month
No children

I clear the requirement for E-ECP.3.1 (a), E-ECP.3.2 (based on point a), E-ECP.3.3 (adequate maintenance).

I do not clear E-ECP.3.1 (b) as I do not have £16,000 in savings (had to send some money back to India for personal reasons).

Does this mean if I apply a visa for my spouse it may be rejected or is there a way around it?

Please advise.

Hi there,

You would apply based on your earnings due to you being in full time employment in the UK. As you have stated you earn well over the £18,600 a year gross which is required. You need to have at least 6 months minimum payslips etc.

You don't need to apply under the category for savings due to the above.

Yes Cat A if employed for 6 or more months.

Category A yes.

Not sure of your particular circumstances and if you need any further advice, but my wife has applied for the same visa in March of this year and we are awaiting the outcome. If you need any questions answering about what you need to submit please ask.
