Tier 1 entrepreneur visa

hi all ,
i have applied under tier1 entrepreneur visa on june 30 2013 , i have been called for the interview on 2014 feb 12 at sheield , and got refused on march 25 , i have applied with partner showing 25000k each in joint account , time being i made a appeal launch at the moment , my partner is now moving to some other catergory as he got only 8 month to qualify for PR as he is completing 10 years in uk,
i don't know what to do as i need to travel back home in 4 month , is it advisable to apply fresh application again in tier 1 category , if suppose will i get the visa ?

help plz

As per my information ur partner can't leave in between while he is completing 10 years if he moves to another catagory without getting this visa then his time period since u applied would not be calculated towards 10 years, this would be a gap between 10 years, he can check properly from solicitor I might be wrong,

you are right. in order to complete 10y there must not be any gap, moving from one category to other during refusal might break continuity.
