Tier 1 Extension granted for 2 years (Post 6th April 2010)

Post by tier1_london » Tue Apr 29, 2014 2:01 pm

I got my Tier 1 General Visa initially for 3 years from Dec 2010 until December 2013 ( I applied in October 2010, so the rules applied where that of post 6th April 2010, so rule 245CB should be applicable to me). I applied for extension in November 2013, but the visa extension was granted for 2 years. I entered UK in May 2011 which means I need another extension now. Looking at some of the other folks here who have written to UKVI (UKBA) and got it changed, I thought of doing the same. I know in my case I got 3 to begin with, so 2 years seems fair. But, the immigration rule (245CB) says otherwise right? I have written to BRP Error email after almost 5 months now asking for correction. Is that the way to get in touch with them? What is the best way to go about this? I would be grateful for any advice.

Thanks UKBALoveStory. This is exactly what I was looking for. I got an email back today from BRPError@homeoffice.gsi.gov.uk asking me to contact the caseworker as expected. I am now sending an email to complaints@homeoffice.gsi.gov.uk[This is the recommended email in the new complaints procedure for UKVI] with copy of BRP and the leaflet that it was sent with. I will post my updates as I get them. Thanks again!!!!

Some Updates

1) 27th April 2014 - Sent Email to BRPError@homeoffice.gsi.gov.uk detailing my case and why I should have been given 3 years visa.
2) 27th April 2014 - Received automatic email which was an acknowledgement that my case will be handled in 5 working days.
2) 1st May 2014 - Email response received from BRPError@homeoffice.gsi.gov.uk telling me that they are unable to help and I should contact the case worker of the PEO.
3) 1st May 2014 - Sent Email to complaints@homeoffice.gsi.gov.uk again detailing my case and also informing them that I had reached out to the BRPError team already. I attached a copy of front and back of BRP and also the copy of leaflet that came along with BRP(For reference number). I also mentioned the contents of 245CB for their ready reference.
4) 1st May 2014 - Received automatic email which was an acknowledgement that my case will be handled in 20 working days.
5) 8th May 2014 - Received an acknowledgement letter on email from LSECSU@homeoffice.gsi.gov.uk stating that my complaint has been sent to the relevant team and that they aim to respond in 20 working days.
6) 3rd June 2014 - Received a letter on email from LSECSU@homeoffice.gsi.gov.uk confirming that an error has indeed been made. They have asked me to send the BRP to the PEO for it to be changed.

Note: I will update the timelines as I send my old BRP and get my new BRP. For others who have a similar problem, I suggest writing to the caseworker directly. That may be quicker. I was not in a hurry, so I followed the above process which was suggested by a member here.

This is great... I am in exactly the same situation myself, except that my 2-year extension was issued more than a year back (April 2013)... It seems quite embarrassing to chase it up as a complaint after so long.. :(

But I will try and keep this forum posted... Let us know when you get your documents back...

Hello Navsingha,
Did you try it? I may be in a similar situation -- I will be reapplying anyway soon for an extension, given that it is being closed. However, I could've delayed the expense of applications for my dependents!!

Hi iubus2005...

I have sent an email to complaints@homeoffice.gsi.gov.uk, but no reply yet... Received an acknowledgement that complaint will be handled within 20 working days which will be over tomorrow... so just sitting tight for now and waiting...

I was given a 2 year extension, rather than 3 years. So, I wrote to UKVI and they extended it to 3 years. Below is the timeline:

Wrote email to complaints@homeoffice.gsi.gov.uk - 10/06/2014
Acknowledgement Email Received - 10/06/2014
Got Phone Call from Case Worker confirming the mistake - 10/07/2014
Email confirmation with instructions on what to do - 10/07/2014
Sent the BRP Cards by special delivery - 10/07/2014
Replacement cards received with extended expiry date - 16/07/2014
