I am confused to decide date of ILR application even after reading many cases; Please comment & advise;
Tier 1 Gen: Dec, 2008 - First Entry: Dec 2008; First Extension: Dec 2011 and Second Extension: Feb 2013 to Feb 2015
Plan to apply on 17-06-2014 (28 days before 15-07-2014) based on:
Year -5: 16-07-2013 to 15-07-2014; Year -4: 16-07-2013 to 15-07-2012; Year -3: 16-07-2012 to 15-07-2011; Year -2: 16-07-2011 to 15-07-2010 and Year -1: 16-07-2010 to 15-07-2009 (Absence: 07/08/2009 to 19/01/2010: 165 days)
Questions:
1- What will be date of application 17/06/2014 or 15/07/2014 as 5-year calculation says, "No more than 180 whole days absence are allowed in any of the five consecutive 12 month periods preceding the date of the application for ILR".
2- Can I apply on 17-06-2014? or even on 02/06/2014 using rule of 180-days (180-165= 15 days more early) then calculation will start from 02/07/2009 when I was not in UK (First entry Dec 2008 and second on 17/07/2009)?
3 - Set O section 6.1 First enter UK: will it be Dec 2008 or July 2009?
4 - Which forms should be used for a separate application (after approval of ILR of Principal Applicant with PEO appointment) of dependents (spouse & 18+ child)?

I think you have to complete a 5 year period from the date of entry in the UK. Have you changed category or tier during your stay Dec-2008.

If you can provide a letter from employer for the 165 days leave. If your start as mentioned above, You are eligible to go for ILR any time after 18/11/2013 (28 days before your 5years duration) date.

But gurus can confirm on this.
