ILR TIER1 Dependent Absences:

Hi All,

I am applying for ILR along with my dependents(Wife and kid) on may 10th.

My wife is out of Uk for almost 3 months though not continuous absence.

Is she eligible for ILR with respective to absences in UK.

Please clarify?

She should be ok. Is she a PBS dep, since when?

My wife and kid are PBS dependents since April 2010.

My son is born in India and is he eligible for Citizenship straight away after I get ILR?

As your child was born in India the application for registration as British will be based on discretion under s3(1) BNA. The HO will expect:

- The child having ILR

- Both parents being British or at least one British and the other settled (ILR in your case) [applications can be made at the same time]

- The child being in the UK at least 2 years if aged 13 or older.
