PR Refused and first tribunal agreed HO decision

hi i just upgrade my situation again, if anyone give me a clue,

i am a non EU citizen and married in 2006 with my EU partner and got RC 2007 till 2012, i submitted papers july 2012 for PR but it refused which was my EU' s 17th months absence, i ahd appealed first tribunal it heared last month and judge agreed HO decision, i am not appeal for upper tribunal, i am getting divorce with my partner, whilst divorce prosess, am i in danger enforment to country? pls anyone who has knowledge about this, give me a advise

Home Office was right to refuse because of absence . I don't understand why you went to tribunal for that. That's clear refusal

You can Retain right residence only if your family member is exercising treaty right at the time of divorce finalised

No you are not in danger yet. You have the right to stay in the UK as long you are a family member of an EU national and that EU national still in the UK

but my PR application refused once and first tribunal was unsuccsessfull too, in this case am i not illegal position?

application for EEA2 , EEA4 ( Family member of an EU national , Permanent Residence ) You do not have to send them if you do not want to. PR application refused so what? You can still retain right of residence and apply PR on your own in future after divorce ( if you meet the requirement )
You will still be considered a legal resident as long as you are a family member of an EU national and that family member living in the UK. UKBA don't have the right to deport you now.
