PBS dep Questions please

Hello Amber

I also have dependent children under 10 yrs of age.

My visa history is as below;

Initial entry clearance: 9 July 2009 - 8 July 2012 (Main applicant + spouse + 2 kids)
Travelled to UK: 7 Oct 2009
Visa extension: valid till 30 Oct 2014 (only main applicant and spouse)

Kids went back to Pakistan before expiry of their initial visa. We did not apply for visa extension of kids at that time for some personal reasons.
Now main applicant + spouse will be eligible for ILR in Oct 2014.

I look forward to know if the kids can be eligible for ILR with parents if they apply for a new visa now to join their parents? Or what can be the other options for them?

Any advice will be of great help to reach some decision.

facing another problem. Yesterday we received a new piece of information from a visa consultant that application for dependents' visa is not accepted by UKBA if main applicant's visa is valid for less 6 months which is our case. Parent's visa is valid till 30 Oct while children's visa can not be applied before 3rd week of May due to some documentational constraints.

Is that true? Is there any reference to this on ukba site?
desperately looking forward to have some idea so we may not be wasting the resources.

What is the option for kids (under 16 years, born abroad) of settled parents to come in UK from Pakistan. Which visa they should apply?

Kindly refer me if it has been discussed in some other thread on this site.

Hello Amber

Kindly help me know the financial / maintenance requirements to sponsor 3 kids (under 10 years of ages). Both parents have ILR status.

I have put together following documents;

1. Application form filled online on the visa4u website and printed
2. Original passports of Children + 2 passports size photographs of each
3. Copies of parents passports
4. Copies of parents BRP cards showing ILR status
5. Birth certificates of Children
6. Bank statements for last 12 months + 12 Payslips + Employment Confirmation Letter showing annual earning around 24,000
7. Sponsorship letter (by father)
8. Proof of adequate accommodation in UK (tenancy agreement + utility bills)
9. UK Savings bank account statements showing > GBP 5,000 funds for last six months.

Kindly check if these docs are ok.
Do appendix 1 and SU07/12 need to be printed and filled by hand?

Thanks Amber. I'm still unclear on how to present and submit this information as VAF4A and Appendix 1 both don't have any section on financial requirements. Pls guide further.

Also pls note that both parents hold the ILR status and children have to apply for settlement visa.

My case comes under 297 (Immigration Rules, Part 8 ) which states as following.
"indefinite leave to enter the United Kingdom as the child of a parent, parents or a relative present and settled or being admitted for
settlement in the United Kingdom".
Is it OK if I give reference to this on covering letter and letter for adequate maintenance?


2.
Kindly guide if my calculations are ok for adequate maintenance.
A : Average net Pay of last 3 months = £1,912.26
B : Rent/Mortgage = 0
Utility Bills (Water/Gas/Electricity) & Council Tax= £215 (do we need to attach some evidence??)

A - B = £1,697.26

C : Income support projections (for one month)
Couple: £492.70
Children: £287.43 per calendar month x 3 Children= £862.29
income support family premium: £75.62

C = £1,430.61

A-B > C

In the end, I am confused over clause (vi) of rule 297.... copied below,

"
297. The requirements to be met by a person seeking indefinite leave to enter the United
Kingdom as the child of a parent, parents or a relative present and settled or being admitted for
settlement in the United Kingdom are that he:

(vi) holds a valid United Kingdom entry clearance for entry in this capacity;"

Please help in understanding what does this refer to?

In my case, Kids had been granted visa initially as Tier 1 dependent but that expired after three years and was not renewed as they stayed in Pakistan.
