Can I apply tier 2 visa after withdraw tier 1 appeal

All Respected members

I applied tier 1 visa last year and it refused and got right of appeal. My appeal dismissed then apply in upper tribunal for permission of appeal and dismissed again.
Now I applied again in upper tribunal for permission of appeal.
Actually I got employer who is ready to sponsor me but I am in difficult situation and double minded to apply for tier 2 after withdraw my appeal
question one
can I apply tier 2 in this situation
Either i go for fresh application for tier 1

Question 2

Any one got tier 2 visa in this situation after applying within 28 days of appeal withdrawn

Plz help and advice me, really helpful me in stress situation

@ naviad13, if you got a sponsor, then you can apply for the Tier 2 visa within 28days of UT decision.

Dear members

I am going through an entrepreneur visa appeal process my status is PSW and i will have to withdraw my appeal to apply for work permit. My question is would I need a labour market test in that case as after withdrawing my appeal my section 3C will end and my status won't be PSW. Also will it break my 10 years long residency ?

@ Anaz786, your last leave will still be PSW, so no need for the labour market test. You can withdraw your appeal and then submit your new application on the same day.

Fax the appeal withdrawal request to the tribunal and also send your Tier 2 application on the same day. Doing this will make your withdrawal date same as your new application date and you should not have any problem at all.
