help for my case

I have been in the UK for 12 years and my last application for leave was after my marriage. I was granted 3 years due to an out of time application in fact I did apply on time but the HO couldn't take the money from the account and that after 9 months when I received the acknowledgment letter 2 days aftr applying. I believe my application was considered an out of time application and doesn't state if I am a discretionary leave or not but I think I might be. My marriage broke down in the past month and I am a father of a British citizen. In that particular case should I try to apply under the long residency or still apply for another discretionary leave and do I stand a chance in any of those cases?

few questions in order to get better picture.
I didn't understand the part i have quote above, when did you receive your acknowledgement letter and when was money taken, how long is your current leave was granted for and on what ground it was granted and lastly how old is your child?

Your article 8 right (private and family life) is well established. You have been here for long time, your are a father of British Child and and also you were previous granted some sort of leave. And so you have good chance to be granted another leave. For ILR it will depends on if 10 years were broken or not. Order your SAR file and then you will know for sure where you stand.

Hi , I was granted 3 years and my child is now 3 years old. I did apply in time 2 weeks before my leave expired at that time. The UKBA could not get the money and after 9 months they returned me my application as invalid. I did reapplied 19 days after they sent me my documents through a lawyer and it came back again as invalid as they could not take the money. I did reapplied after 18 days this time and it was finally succesful. the whole process took nearly 11 months from the time of my last visa was valid. It will now be 13 years I am in the UK and prior to that I did not have any immigration issue
