Hi Abdoul,
Answer to question 1 is, yes your wife can apply a SET(M) application straight after getting her FLR(m), as she is PBS dependent prior to 12 July 2012, and still covered by the transitional arrangements under part 8 of immigration rules.
Regards to question 2, I am really sorry not sure about that, so I won't suggest any thing.
Regards to question 3, no that doesn't have any effect on the timeline of your application. Every one send their applications to the same address, and the biometric are send through from the same place, so you will be following the same time line as any one else.
Looking at your timeline, fingers crossed you should probably get the good news in the coming week or so.

Hi I do not think you can apply for ILR for your wife just after her FLR (M). I think she will have to wait till 5 years or apply when she is 10years on 2017 since she will be applying after 6th April 2014.

It is quiet tricky as everyone got a different opinion,I hope more members will come forward regarding that,thanks a lot for ur contribution,I will continu to seek advice till we all know wich path is the real one

Came to the UK on 8th March 2004. I spent last 9 months on 3c and 3d. My UT appeal was refused on 28th Feb and i applied for the ILR on 11 March 2014. So a gap of 11 days. As it is within 28 days time period so think it should be ok.?

In regards to PBS dependants of main applicants gaining ILR based on long residence, I received the following response from UKVI.

Transitional Arrangements

Question: An applicant was granted leave onto the family route before the 9 July 2012 change to the Immigration Rules. Do they need to meet the new Rules in Appendix FM at their extension application?

Answer: No, anyone granted leave on the basis of the Rules in place before 9 July 2012 will need to meet those Rules when applying for further leave or ILR. Please see the above Transitional Arrangements guidance on our website.



Question: Do all dependants of PBS Migrants who have been granted ILR need to apply for leave to remain as the Partner of a settled person?

Answer: This will depend on how the PBS Migrant applied for ILR. If they applied on the basis of being a PBS Migrant (for example under Tier 1 or Tier 2) then their dependants will not need to switch and can apply for an extension as a PBS dependant until they meet the requirements for ILR themselves.

If the PBS Migrant applied for ILR under the Long Residency provision, then their dependants are no longer considered as dependants of a PBS migrant and they must apply for permission to stay in the UK in another category.

Question: A PBS dependant has applied as the Partner of a settled person, are they considered under Part 8 or Appendix FM of the Immigration Rules?

Answer: From 6 April 2014, all dependants of PBS migrants who apply for leave to remain as the Partner of a Settled person on form FLR(M) will be considered under Appendix FM of the Immigration Rules. They must meet all the requirements of these Rules (including the financial requirement where necessary). The above Transitional Arrangements guidance will be updated to reflect this position.



A PBS dependant applying directly for ILR on form SET(M) will not meet the ILR requirements and they must first apply for limited leave on form FLR(M).


Qualifying Periods

Question: An applicant needs to meet a qualifying period before applying for indefinite leave to remain (ILR). When does this begin?

Answer: If they entered the route overseas, the qualifying period will begin when they arrived in the UK. If they ‘switched’ into the route within the UK, the qualifying period begins on the date they were granted leave.



Question: Do dependants of PBS Migrants who apply for LTR as the Partner of a settled person begin their qualifying period again?

Answer: If the applicant was granted LTR under paragraph 284 of Part 8 of the Immigration Rules (following an application made prior to 6 April 2014) they can combine their leave as a PBS dependant with leave as the Partner of a settled person to meet the qualifying period under paragraph 287.

All other applicants must start their qualifying period again.

its 14 calender days from the day you received the judgement by post. Yes it should be Ok as it is within 28 days, moreover, if you dont have A 47 removal order as in my case then you have 28 days to apply afresh in any category. those 28 days counts in legal stay as well.

Hello everyone,
I have a little confusion about English language ability which was introduced last year along with KOL test.

Question:
If a person is applying long residence 10 years ILR and he had studied master degree at UK university which is in government list then what need to attach either degree certificate or transcripts showing subjects studied with marks? And whether still NARIC comparability report needs?

You have claimed Benefit absolutely in your merit. I don't think so she will get any problem for that. Requirement is you have to show adequate finance for your wife. Hence your wife already earning good money far above the requirement. So don't worry she will get her ILR by her own merit. Most important thing is you are eligible for Public Fund. If she would not work then it will have a adverse affect on her application.

Tulib143, that is incorrect advice!

Ali1975, tax credits must be in joint names! Housing benefit must take into account your spouse's income, at first instance it isn't and that could be benefit fraud. This could be enough to not only result in disallowance of your SET(M) but also prosecution.

just checked with HO and a very kind lady has confirmed the case worker is on the case as of now, lady's name was "Yelea" it might be helpful if someone is calling HO and if they get thru to her. hopefully i should get some news by end of this week.

Yes I have just sent them a letter. I phoned them in the morning and then sent a letter explaining every thing. I requested them to expedite my application as we have urgent travel plans. Today HO confirmed that they are treating my application on urgent bases. So my time line can not give you the exact view of waiting times. I submitted Biomatrics on 22/04/2014.

Hardik i am in same situation as you were.
Last two years on section 3c and withdrawn appealed from COA via email and applied same day.

Did they accept that they will treat it under old rules .wish you best of luck in the same boat as yours
