Hi ,
i )i got my biometric done in March 2013 when i got my tier 1 general extended till 2015. but i have already submitted my application for SET (LR) application under 10 year residence on 29th april 2014. my question is whether i will be required to have another biometric done or not?

ii) Another question is that my wife will be giving ESOL entry level 3 (which is equivalent to B1) exam in a few days which is requirement for SET LR. The recognized institution is city and guild . will the same test go for FLR M ? as it is mentioned everywhere that for FLR M you need to pass A1 ? or she will have to pass A1 for FLR M and then B1 for SET LR as in my opinion B1 being the higher level test should go with both the applications.

hi ,
my wife got herier 1 general dependant visa in october 2011 and she entered UK in january 2012. My wife visa tier 1 general dependant is valid til march 2015. in april 2014 i applied for my SET LR . After i get my SET LR what will be her status and what visa will she be applying for then ? will it be ILR directly or she will have to apply for FLR M first and then ILR ? and if she have to apply for FLR M first then after FLR M how long will she have to wait for to apply for her ILR ?

hi , please mention clearly the reason why the application was refused because city and guild certificate is clearly mentioned in the list.
as level 3 which is equivalent to B1 is higher then level A1 , A1 being the minimum requirement for FLR (M). and B1 is the minimum requirement for ILR. in my opinion B1 should go well with FLR (M).. Correct me if i am wrong . Also can you please notify which documents did you submit for english language test.

I submitted certificate in ESOL Skill for Life (entry level 3) from City and Guilds and case officer wrote it is not listed in appindix O immigration language test courses.

Flr(m) through 10 years long residency

Hi all gurus esp. Ambers,

Today i have successfully received my wife flr(m) all docs from HO as she applied on 04th april and done bio 15/04/2014 now we are waiting for BRP. This is the first time in my 10 years history HO sent all docs by royal mail recorded next day delivery.

Anyway Caseworker sent me a leaflet with my docs which says:

When and how can i apply for further indefinite leave to remain or set(m)?

" in order to qualify for settlement you must have completed continuous period of at least 60 month in the Uk with limited leave as a partner under paragraph R-LTRP 1.1(a) to (c)."

Can you pls advise me where she can apply set(m) now or not as she fall in old rules came in uk june 2011 applied flr(m) before 6th april.

yes, Biometric will be invited with every new application.

Why would you fill 7-A, when your wife was clearly a PBS Dep. prior to 09th July 2012, and you were applying before 06th April 2014 ??
I believe that must have confused the case worker. I hope she has 2 years on the FLR(M) ?

Good question! After all research with this forum and also my own friends got flr(m) to set(m) before 6th april and i decided to fill up section 7 to avoid a letter or something else from case worker to fill section 7.

Caseworker won't confused as i have clearly explained on the cover letter as she is under old rules. Thx.

Lets see what happens if they do mistake they have to correct it.

Called HO just now .customer service lady said my packaging is already posted and should receive it shortly .I'm too much stressed now.if they refuse any application do they send packaging or do they just send letter and keep passport and everything.

Hi Guys,

Following my ILR last week, I am getting all the documents from my solicitor tomorrow. I am writting a follow up cover letter to HO asking them to start processing my wife's FLR (M) application that we posted on 5th April 2014. My wife is in UK since 2007 and her last leave was Entrepreneur dependent.

Should I be cheeky to mention in cover letter stating that they should consider the application on old rules? is that going to offend HO staff?

Hi Kalps999,
I still haven't received my ILR, but hopefully soon INSHALLAH. My wife applied for the FLR(M) on the 02nd of April, and she is in the country since 2007. The question that you asked, I was thinking on the same footings, considering the quality of case workers in the Home Office, we can't take any chances. I will make sure to put a cheeky little comment that as she is covered under the old rules, hence she is entitled to......
Not really sure what the wording should be, but I have decided to nudge them in the right direction. I hope other members will agree, as there are many in the same situation like us.

Hey mate,
I wrote them a letter yesterday it is received today now lets see what happen. I spoke to quite a few people and there is a very divided view about my situation some people think given the fact I was not a settled person when My mrs applied for FLR(m) they may implement rules on the day I got my ILR. So waiting hoping for the best that they Issue her 2 year Visa if not I may go for JR as 5 year is too long to wait......
