Tier 1 (General) extens. can you apply w/i 28 days of expiry

Post by DLAM » Tue May 13, 2014 11:45 pm

Hi all,

I have a valid tier 1 extension (general migrant) that expired 09 May 2014.

Can I STILL put in a valid application with the home office for an extension AS LONG AS it is within 28 days of the date of expiry (09 May)?

Is that true? So even if they rcvd the application 10 days later - or 3 days later than 09 May - the fact that it is late will not hurt the application IF the application is all in good order w. paperwork and in good standing?

IF - I can in fact apply within 28 days of date of expiry - where in the language/ what page in 32 guidance pages - does it say that? explicitly?
anyone have the exact language or page number in guidance notes?

As an issue happened with my courier. Instead of delivering my package 09 May. the incompetent fools delivered it 12 May.... but I am hoping and praying to god that I may still fall under some '28 day rule' that was alluded to in the tier 1 visa extension form....

THANK YOU SO MUCH in advance for your advice.

I only learned a few hours ago that my courier did NOT deliver to home office on 09 May (date of expiry) but delivered 3 days after (12 may)

so the home office rcvd my package 3 days after my visa officially expired

obviously - i am in a panic

As long as you posted the application before your leave expires that should be fine.

i couriered it before the leave expires

but i did NOT post it before the leave expires

i couriered it 08 may
the visa expires 09 may
but rules say that if couriered - application date is the date the home office rcvs the package - which is 12 may.... which is 3 days after the visa expires

so it gets back to my original question

can one apply for an extension AFTER their visa expires

specifically , 3 days after

bc the home office could grab me on a technicality... if they want to

as the courier picked it up 08 may
guaranteed next day delivery 09 may
then screwed up and did NOT deliver the package until 3 days after my visa expired....

hence
panic attack
