Shahjeeeeee........Keep tight you are not far....definitely next week I hope your case is straight forward......
In My Mrs Flr (m) case I have requested them politely but very clearly by mentioning all the dates and history that she comes under Old rules......lets what happens....

Following my ILR last week, I am getting all the documents from my solicitor tomorrow. I am writting a follow up cover letter to HO asking them to start processing my wife's FLR (M) application that we posted on 5th April 2014. My wife is in UK since 2007 and her last leave was Entrepreneur dependent.

Should I be cheeky to mention in cover letter stating that they should consider the application on old rules? is that going to offend HO staff?

Hi Kalps999,
I still haven't received my ILR, but hopefully soon INSHALLAH. My wife applied for the FLR(M) on the 02nd of April, and she is in the country since 2007. The question that you asked, I was thinking on the same footings, considering the quality of case workers in the Home Office, we can't take any chances. I will make sure to put a cheeky little comment that as she is covered under the old rules, hence she is entitled to......
Not really sure what the wording should be, but I have decided to nudge them in the right direction. I hope other members will agree, as there are many in the same situation like us.
Please keep us posted what ever you do. All the best.
Kind regards
Shahjee

Hi all,

I applied for 10 yr ilr and we have just got some news from home and have to travel ASAP. I have seen on this forum that I can request my documents based on compassionate grounds.

Could someone please tell me what I need to do so I can travel hopefully by Thursday for the latest.

Your help will be greatly appreciated.

Many thanks

Hello,
I am in same boat unfortunately and my father is seriously ill,I spoke to HO today and they asked me to send the Hospital/doctor report along with covering letter. They lady said they probably look into it and will contact with you. One thing I am sure I am going through lot of stress now. I applied 0n 28/02/2014 for SET (LR).
Thanks

Thanks for your reply M Faisal. I will prepare that in the meantime and then make contact with
HO in the morning.

It's a very stressful situation to be in for sure.

Will keep your dad in our prayers.

Hi Ton2014
I am sure that case worker made mistake as per understanding.I have submitted same cerficate for my wife at Croydon. It was perfectly ok. Case worker just looked at appendix o that means selt but he or she didnot realise from 28th of October 2013 there has been new rules established which give ur wife right to use this certificate. Main thing is if u provide entry level 3 cerficate which is OFQUAL registered then home must obey this cerficate. I am 100% sure u can overturn this decision. Write the cover letter to specific case worker that u think he or she overlooked the new rules.
I have enclosed the link which u can find new rules provided by the HOME OFFICE.
https://www.gov.uk/government/uploads/s ... t-koll.pdf
U can find ur answer in page number 5 to 6.
Take care
Let me know
Thank u

Hi Guys,

I have drafted the letter to HO. Can someone please be kind to advise should I name the old rules in the covering letter? I vaguely remember it's Part 8 transitional arrangement or something. I would be grateful if someone direct me to correct rules that can go on cover letter.

Many Thanks
Kalpesh.

supers wrote:My ILR on 10 years residence application is refused with appeal right.

The reason is that - I had an application on 22nd January 2007 for SEGS and they could not take money from the credit card. They refused the application on 24 january and gave 28 days to re-apply. Unfortunately, i did not receive the latter with my document. at the beginning of March 2007 i have called HO that I did not here anything and they replied they have sent the application long ago and could not gave any ref how can i get.. asked me to contact royal main..I contact and collect..I called HO again that 28 days is already over they say just fill the payment page and send the document..I got visa..

I applied SAR…and it says that in the summary there is no overstay for more than 28 days..but the application acceptance and rejection was mentioned on the time line..

I have been here 9 years as student 1 year SEGS and did MSc with Distinction and just completed PhD…

Any advice, help or how to appeal..or anyone been through such situation…please please…christmas holiday is approaching.
Hello guys,
Following my above post. My appeal was allowed by the judge on 20 March 2014..So far I have not hard anything form HO..I called them this morning and the lady said the application is not with the case worker yet..I called my lawyer, he said he will write a letter to HO regarding this matter.

During my conversation with HO, I told them the time line for the court determination to got to case worker is 4 weeks and she said "There is no time-line!".

This really important to the visa ASAP..it's been 8 month since the application..can't wait anymore..need to get a job..get my life back!
