just to let everyone know.. since my ILR was approved on 08/05/14 and HO almost lost my docs and passport, after sending 2nd request for the documents to be sent.. i have finally received my PP and Docs.

Thats great news...What about you wife's Flr (m) what is your plan r u going to request administrative review have you discussed with any one that what r ur options .......

No i did not fill 7a only 7b and mainly relied on savings of three months

Hi Guys,

Wondering if someone can shed light on this query.

I will be eiligible for British Citizenship next year. My wife just got FLR (M) approved on Old rules. Can my wife apply for Direct British citizenship using AN form without applying for Set (M)?

Gulll - i had exactly same issue - all previous applicaiton was in time and valid - only last application was refused on earning basis - i had appealed (IN time) and withdrawn 27 days before I finished 10 years and reapplied on the same day.(i had not face any adversaries) - as you can see i have successfully got the VISA.

when i applied solicitor did advised me that - in case if they refuse my 10 yrs ILR - where caseworker wrongly interprete the law - we can appeal and easily win as under imigration act section 3C & 3D appeal time is considered towards the continious (in case - caseworker dont know).
Once again thanks a lot for your help.
Hardik, what I have understand from your post is, if in case my application falls in for refusal still I will be able appealing against the decision? But the guidance notes suggest that if you apply even on the same day of withdrawing appeal still they consider it as an out of time, so the only appeal forum would be Judicial review then? Please correct me if I am wrong.

Inshallah you will receive good news this week.I applied 31/1/14 and biometric done on 27/02 ,approval 13/05/14. Yours and mine kinda same time line but I applied a week before yyou .Give them a call on Tuesday or Wednesday.. You should get a response from them.

Your wife need to apply with SET M then after 12months of successful SET M, she will now apply for Naturalisation using form AN

Hello guys,
Following my above post. My appeal was allowed by the judge on 20 March 2014..So far I have not hard anything form HO..I called them this morning and the lady said the application is not with the case worker yet..I called my lawyer, he said he will write a letter to HO regarding this matter.

During my conversation with HO, I told them the time line for the court determination to got to case worker is 4 weeks and she said "There is no time-line!".

This really important to the visa ASAP..it's been 8 month since the application..can't wait anymore..need to get a job..get my life back!

I also had a invalid application due to the payment long time back in 2007 for which i don't have any HO letters with me at the moment , probably i have thrown them away during house moved ....bit worrying about it though ...

Guys need ur help plz......

I have got my ILR today ....
My wife came to the uk in 2010 on my tier 1 dependent which is still valid till July 2015.
My question is that whether she will come under old rules or new ruled whic is 5 year waiting period.
I have been to 4 solicitors to clear this issue to be honest they dont even have the answer ...I dont know totally confused ur guys help much appreciated....

Those who apply to switch to FLR(M) from PBS dep after 6 April 2014 will be on a 5 year route to settlement.

But couple of experiences in this post for pre July,12 dependents applied FLR(M) after 06 April 2014 at PEO and switched to SET(M) in a week. Please Comment.

Hi Khanzada khan,
As Amber rightly answered you that any one applying for their dependants after 06th April 2014 will be under the new rules, hence a 2.5 years visa after the FLR(M) which could be extended to a total of 5 years, so that they could spend that as their qualifying period for their SET(M) for indefinite leave to remain.
In your case your Mrs is pre July 2012, and though rules are quite clear but you know, with the quality of case workers that you get at the Home Office, just yesterday two members who applied for their dependants, who were pre July 2012, and pre 06th April 2014 got completely different visas, one got a 2 year under old rules, and another got a 2.5 years under new rules. I mean to say you never know if you get lucky and get a 2 years one. Please keep following the cases on this forum and that will give you a clear idea of what is happening.

Many thanks Shahjee lets c.As I mentioned I been to 4 soliciyors they dont no either.one of the solicitor told me pre july 2012 dependents are excluded from this new rules but ehen I asked him about any ref he had nothing in written .I was thinking to withdraw and wait one year to get ILR with my wife on same day but its too late now.I think my friend is withdrawing his long residency case on monday which he apllied on 30 Feb....
