Query on new visa fee rules on Tier-2

Now Tier-2 general visa fee categorized in to two :

Up to 3 years
Over 3 years
Depending on what category one on, visa fee will be different.

Those who apply first time Tier-2 , it will be easy to find what visa fee they will select.

But it is not clear for those who are already on Tier-2 for few years.

Suppose one already in Tier-2 for 3 years and needs extending visa and employer issued COS for him for another 2 years.
What visa fee category he should select? Up to 3 years one or over 3 years? If he extends his stay he will be more than 3 years, but only extending 3 more years to do so.

Does more than 3 years mean only number of additional years he is going to apply ( it will be 2 years in his case ) or number of total year one in on Tier-2 ( it will be 5 years in his case : 3 +2 )?

Much appreciating if anyone can answer this dilemma.

not sure if this helps but this is what i just had to do for an extension/change of employment

I've been on tier 2 for about 2 and a half years now

my new sponsor (approval pending) put down for a full 5 years, knowing that actual time will be shortened to make my total 6 years i think

i therefore had to pay the higher fee as it is dependent on what the sponsor puts down, so if your sponsor puts down below 3 years you pay that fee

which is my understanding of it
