Hello mate,
Every one follows pretty much the same time line, and it actually depends on the date that you apply. You rightly said that the timeline now is about 12-15 weeks, and I would presume that it should be the same for you. Mind it that you can apply 28 days prior to the completion of your 10 years, and remember to write them regards to you varying your Tier 4 application to SET(LR) application. All the best.

Hi K4,
You are eligible to apply 28 days prior to completion of your 10 years from the date of your entry, so mind it, it's your entry stamp to UK that matters not the date you got the visa, so please don't confuse it. I hope it helps mate.

I have one question - those that part of 10 years were under EEA did UKBA return your residence Card ? they have not returned my Residence Card EEA2 . I would be grateful if you could clarify it as Residence Card was giving me the right to travel in Europe without Visa .

You are right looks like the Home Office have gone lazy :lol:
You can see that one of the member from January applications just got his ILR yesterday, so looks like there is still a bit of a backlog from January, hence we are the lucky one to be waiting.
I called Home Office yesterday and they say that the application is still incomplete, so I asked her what do you mean incomplete, she replied that it is out with a case worker for decision, hence means to say under process :( so the long wait continues.
But your and my timeline is the same, so please keep us posted with your results........hope soon.

THAT ANSWER CONFUSED ME THAT EITHER MY FORM IS INCOMPLETED OR ANY DOCUMENT MISSING AND THEY ARE ASSUMING MY APPLICATION INCOMPLETED.

Hi Zaiby,
I am afraid that the answer is NO, as after the 06th April 2014, any dependants applying for an FLR(M) have to spend qualifying time of 5 years for their ILR.
If I am you, I would withdraw my LR application and apply with my dependants in March 2015, I know it is completely unfair for the Home Office to make such a drastic change knowing that it will effect honest people like you go through the agony and pain of waiting for another 5 years to get their life's on track.
I hope other senior members will comment to explain as well.

It's the bank holiday weekend coming, plus the kids going on the half term holidays so rule out quick decisions. Looks like we got caught up in that line of bank holidays and half terms, hence the delay :(

It will be OPTION 2. She will have to wait for 5 years to apply for her ILR from the day her FLR(M) is issued.

Hi Zaiby,
Option1 is wrong and option 2 is correct.
Any PBS dependent that opts to switch to FLR(M) after the 06th of April 2014, have to start a new qualifying time of 5 years from the date of the grant of FLR(M). They will be issued with a 2.5 years visa initially which will be extendable for another 2.5 years to make it a total of 5 years to help them qualify for their ILR. They will lose all their previous time spend on the PBS dependant status, and that is according to Appendix FM of the immigration rules.
Now that was what the rules are saying, but you could see that on the forum there are many members who have applied for their dependants before 06th of April 2014, and still they were issued with wrong visas of 2.5 years under new rules. I mean to say that with the quality of case workers that Home Office have, expect the unexpected, any thing can happen. It is appalling that honest people like you, who followed a straight path and were told by the Home Office before that the dependants are on course to settlement, and now their time spend during course to settlement is not considered.
I am not suggesting any thing, but frankly 10 years LR is a case that you should rely on if it is convenient for you, not if it is a major source of inconvenience. Think hard about the availability of choices for you.

Option1 is wrong and option 2 is correct.
Any PBS dependent that opts to switch to FLR(M) after the 06th of April 2014, have to start a new qualifying time of 5 years from the date of the grant of FLR(M). They will be issued with a 2.5 years visa initially which will be extendable for another 2.5 years to make it a total of 5 years to help them qualify for their ILR. They will lose all their previous time spend on the PBS dependant status, and that is according to Appendix FM of the immigration rules.
Now that was what the rules are saying, but you could see that on the forum there are many members who have applied for their dependants before 06th of April 2014, and still they were issued with wrong visas of 2.5 years under new rules. I mean to say that with the quality of case workers that Home Office have, expect the unexpected, any thing can happen. It is appalling that honest people like you, who followed a straight path and were told by the Home Office before that the dependants are on course to settlement, and now their time spend during course to settlement is not considered.
I am not suggesting any thing, but frankly 10 years LR is a case that you should rely on if it is convenient for you, not if it is a major source of inconvenience. Think hard about the availability of choices for you.

Shah ji

one of my friend had a case of deception from home office.
he won the appeal and was granted student visa and there after psw.
HO put an allegation on him that he used deception for his further leave to remain and issued the notice of removal from UK.
but later he won the case.
this happaened in january 2008.

now he is going to complete his 10 years period. he is worried that period of temporary admission will considered as legal period and further he will be successfull to get ILR.

I am really sorry that you have to go though all this hassle because some one at the Home Office,( who were so out of touch with the reality) decided to change the rules. But on a positive note, February 2015 is not far, at least you and your Mrs will get sorted together rather than all this wait.
