New Born May 2014 : Parents got ILR Apr 2014

Post by roomanalisyed » Thu May 22, 2014 8:44 pm

Hello There,
I need some advice on applying for British Citizenship for my new born baby girl ( May 2014 ). We are Indian Passport Holders and I got ILR this April 2014, my wife and one daughter ( not the new one ) were my dependent on Tier-1 Visa. We have new born daughter on May this year 2014. I am looking to apply for her BC/Passport. I downloaded the form MN1. But there are so many sections which really confuses me.

For e.g. -
Form Sections :

1.5 - Should it be Surname and First Name because it says Surname/Family Name?
1.9 - Present Nationality

2.1 - Do we need to fill this section at all ? or shall we provide details based on her birth since at present location.

3.1 - it says "Please say which parent is the one who is a british Citizen by descent and on whom this application is based" - what about settled people, which it does not talk about.

4 - Good Character requirement. Again, do I need to fill this section ?

5 - Referees and Identity. Again, do I need to fill this section ?

6 - Consent- We signed and filled, hope this is right thing to do. Please confirm.

7 - Declaration
7.1 - Should it be my name ( Father's ) or Child name ( new born ) ?
7.6 - if this is not applicable should I cross it or still need to tick it ?
7.8 - ----same as above ------
7.9 - ----same as above ------

I appreciate your help and guidance.

Looks forward for advice.

Thanks,
Syed

Hello,
I was going through Guide MN1 and found this on Page 7 of it -

"Automatic acquisition of British citizenship
Children who have automatically acquired British citizenship do not need to be registered.
There are two ways a child can automatically be a British citizen without needing to
register.
1 British citizenship otherwise than by descent
A child born in the UK to parents one or both of whom are
• British citizens, or
• are settled in the UK at the time the child is born, or
• members of the UK armed forces
is automatically a British citizen otherwise than by descent and does not need to be
registered."

Again confused..... :-(

As your child was born in the UK when you had ILR, your child is British. There is no need to register the child on MN1 just apply for their British Passport.

Hi amber

As I am in the same situation I got my ilr on 12th MAy 2014 and my child born on 15th MAy 2014
Is that mean I don't need to fill MN1 form and spend £673 pound for certificate
If thats the case let me what documents required for British passport form
I have already booked the appointment for next Wednesday
Thanks

Yousuf

Yes the child is British, assuming born in the UK, for a Passport you'd need the child's birth certificate and proof you were settled when the child was born, e.g, your BRP.

Hi Amber,

same situation for me...

Do I need to send my passport with ILR BRP or BRP is enough along with Birth Certificate?
