Questions on Ireland directive visa

Post by NaaNaa90 » Sun Apr 27, 2014 1:11 pm

Hi all,

My friend (a British citizen) is planning on going down the Directive route and moving to Ireland with her husband who is a non- eeA national. She wanted help regarding a few matters before she went down the route;

1) Is it okay for the wife to meet the husband in the airport or will they need to get off the same plane and see the immigration officer together?

2) She does not fully understand how she will excise treaty rights as she is currently 3 months pregnant and is planning to go to Ireland in 2 months and she also has a 2 year old boy.

3) Can she put herself down as self employed for example if she sells cakes from home. Bearing in mind that her income will not be very high.

4) Is there a minimum set figure that she needs to earn in the 3 months time frame? e.g If she's employed for 10 hours a week?

5) What benefits can she apply for whilst she is in Ireland? Including Maternity and Child benefits, what is the Irish equivalent to Tax credits, and will she be eligible?

6) She has savings, but what is deemed self sufficient with regards to figures?

7) How will she go about receiving CSI Comprehensive sickness insurance?

Your swift reply will be much appreciated as she would like to join her husband before she gives birth.

THEY COULD MEET AT THE AIRPORT IF SHE IS ALREADY IN IRELAND. THEY WILL BE ABLE TO APPLY TO TRAVEL TOGETHER OR FOR THE NON-EEA SPOUSE TO TRAVEL TO MEET THE EEA CITIZEN IN THE COUNTRY. THIS SHOULD BE MADE CLEAR WHEN APPLYING FOR THE VISA. I THINK IT'S ALWAYS EASIER TO TRAVEL TOGETHER, BUT IT'S NOT ESSENTIAL

2) She does not fully understand how she will excise treaty rights as she is currently 3 months pregnant and is planning to go to Ireland in 2 months and she also has a 2 year old boy.
THAT IS SOMETHING THAT SHE NEEDS TO CONSIDER VERY CAREFULLY! TO EXERCISE TREATY RIGHTS, SHE MIST BE WORKING/SELF-EMPLOYED/STUDYING (WITH MEDICAL INSURANCE) OR SELF-SUFFICIENT (WITH MEDICAL INSURANCE). IT SOUNDS THAT WORKING AT THE MOMENT MIGHT BE OK AS SHE IS ONLY 3 MONTHS PREGNANT, BUT SHE NEEDS TO CONSIDER WHAT WILL HAPPEN WHEN THE NEW BABY IS ABOUT TO BE/IS BORN. OF COURSE, IF THEY CHOOSE SELF-SUFFICIENCY SHE NEEDS MEDICAL INSURANCE AND THEY WILL NEED TO SHOW THAT THEY HAVE ENOUGH MONEY IN THE BANK. I DON'T KONW ABOUT EXACT FIGURES, SORRY.

3) Can she put herself down as self employed for example if she sells cakes from home. Bearing in mind that her income will not be very high. SHE CAN BE SELF-EMPLOYED IF SHE DOES THIS. SHE WILL NEED TO FOLLOWING THE GUIDELINES FOR BEING SELF-EMPLOYED IN IRELAND: http://www.citizensinformation.ie/en/em ... idual.html. SEE QUESTION 4

4) Is there a minimum set figure that she needs to earn in the 3 months time frame? e.g If she's employed for 10 hours a week?
NO MINIMUM AMOUNT OF MONEY, OF COURSE IF SHE IS EARNING 5 EURO PER WEEK THAT'S JUST RIDICULOUS. MANY PEOPLE SAY THAT WORKING FOR 12 HOURS PER WEEK IS ENOUGH (SOMEONE ON ANOTHER FORUM NOTED THE CASE OF: C-139/85 Kempf WHICH NOTES THAT 12 HOURS ARE ENOUGH). THE EASIEST WAY TO PROVE THAT IS BY BEING EMPLOYED BY A COMPANY AND RECEIVING PAY SLIPS. IT CAN BE HARDER TO PERSUADE THE UK AUTHORITIES THAT YOU HAVE BEEN SELF-EMPLOYED. THEY ASK FOR QUITE A LOT OF INFO.

5) What benefits can she apply for whilst she is in Ireland? Including Maternity and Child benefits, what is the Irish equivalent to Tax credits, and will she be eligible?

I'M REALLY NOT SURE ABOUT THIS BUT I THINK SHE WILL BE ABLE TO BE ELIGIBLE FOR BOTH MATERNITY AND CHILD BENEFIT. NOT SURE ABOUT ANY OTHERS. HOPE SOMEONE ELSE WILL HELP HERE. 'BRIGID FROM IRELAND' KNOWS A LOT ABOUT THIS.

6) She has savings, but what is deemed self sufficient with regards to figures?
NOT SO SURE. BUT I THINK A GOOD REFERENCE POINT IS THE FAMILY INCOME SUPPLEMENT FIGURES. THERE SHOULD BE SOME USEFUL INFO HERE: http://www.welfare.ie/en/Pages/275_Fami ... spx#l62fd2. I'VE READ BEFORE THAT SOMEONE SAID THAT IF YOU EARN MORE THAN THE AMOUNT WHERE FIS KICKS IN IS YOU WILL BE FINE. I DON'T KNOW IF THIS IS TRUE. HOW MUCH DOES SHE HAVE (ROUGHLY)?

7) How will she go about receiving CSI Comprehensive sickness insurance?

SEE HERE FOR SOME COMPANIES (JUST FOR EXAMPLE): http://www.irishhealthinsurance.ie, http://www.avivahealth.ie. I'M SURE THERE ARE OTHERS TOO. GOOGLE...

Your swift reply will be much appreciated as she would like to join her husband before she gives birth.
SHE SHOULD PROBABLY READ: http://www.citizensinformation.ie/en/mo ... ional.html
http://www.inis.gov.ie/en/INIS/Pages/WP07000168

WISH HER GOOD LUCK!

You can probably find some info here: http://europa.eu/youreurope/citizens/wo ... dex_en.htm
or: http://www.revenue.ie/en/tax/it/residence.html

Sorry, I don't know much about this.
